The Toxics Release Inventory (TRI) is a publicly available database containing information on toxic chemical releases and other waste management activities in the United States.
The database is available from the United States Environmental Protection Agency (EPA) and contains information reported annually by some industry groups as well as federal facilities. Each year, companies across a wide range of industries (including chemical manufacturing, metal mining, coal- or oil-burning electric utilities, and other industries) that manufacture, process, or otherwise use more than a certain amount of a listed chemical must report it to the TRI. For most listed chemicals, facilities must report if they manufacture 25,000 pounds or process or otherwise use 10,000 pounds of the chemical, but some chemicals have lower reporting thresholds. [1]
The inventory was first proposed in a 1985 New York Times op-ed piece written by David Sarokin and Warren Muir, researchers for an environmental group, Inform, Inc. [2] Congress established TRI under Section 313 of the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA), and later expanded it in the Pollution Prevention Act of 1990 (PPA). [3] [4] The law was developed out of concern about Union Carbide's releases of toxic gases in the 1984 Bhopal disaster (India) and a smaller 1985 release at its plant in Institute, West Virginia. [5]
Facilities are required to report to the TRI if they meet all of the following requirements:
If certain criteria are met, the facility may be allowed to complete a "Form A" certification statement instead of the more detailed "Form R." Form A may only be used for chemicals that are not considered chemicals of special concern, for which amounts manufactured, processed, or otherwise used at the facility do not exceed 1 million pounds, and which do not exceed 500 pounds of annual reportable amount (i.e., total quantity released/disposed of, treated, recycled, and combusted for energy recovery) in the calendar year. Facilities must report quantities of listed chemicals released to the air through stacks or fugitive emissions; quantities directly discharged to water on-site or to a publicly owned treatment works; released or disposed of to land, such as in a landfill or injection well; and quantities of waste transferred off-site for disposal or release. The PPA added requirements for facilities to report information on quantities of production-related waste managed on- and off-site through recycling, combustion for energy recovery, treatment, and disposal of other releases, and to report information on quantities of waste managed due to one-time or non-production-related events. Facilities also report information on any source reduction activities undertaken to prevent pollution.[ citation needed ]
Every year, EPA publishes the TRI National Analysis, which interprets the reported TRI data and examines trends in releases, waste management practices, and pollution prevention (P2) activities. The National Analysis includes an analysis of trends in releases and waste management, as well as analyses of important industry sectors, chemicals of special concern, and a "Where You Live" tool that maps the data. The Environmental Protection Agency (EPA) is an independent agency of the United States government tasked with environmental protection matters. President Richard Nixon proposed the establishment of EPA on July 9, 1970; it began operation on December 2, 1970, after Nixon signed an executive order. The order establishing the EPA was ratified by committee hearings in the House and Senate.
Industrial waste is the waste produced by industrial activity which includes any material that is rendered useless during a manufacturing process such as that of factories, mills, and mining operations. Types of industrial waste include dirt and gravel, masonry and concrete, scrap metal, oil, solvents, chemicals, scrap lumber, even vegetable matter from restaurants. Industrial waste may be solid, semi-solid or liquid in form. It may be hazardous waste or non-hazardous waste. Industrial waste may pollute the nearby soil or adjacent water bodies, and can contaminate groundwater, lakes, streams, rivers or coastal waters. Industrial waste is often mixed into municipal waste, making accurate assessments difficult. An estimate for the US goes as high as 7.6 billion tons of industrial waste produced annually, as of 2017. Most countries have enacted legislation to deal with the problem of industrial waste, but strictness and compliance regimes vary. Enforcement is always an issue.
Toxic waste is any unwanted material in all forms that can cause harm. Mostly generated by industry, consumer products like televisions, computers, and phones contain toxic chemicals that can pollute the air and contaminate soil and water. Disposing of such waste is a major public health issue.
Superfund is a United States federal environmental remediation program established by the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA). The program is administered by the Environmental Protection Agency (EPA). The program is designed to investigate and clean up sites contaminated with hazardous substances. Sites managed under this program are referred to as Superfund sites. Of all the sites selected for possible action under this program, 1178 remain on the National Priorities List (NPL) that makes them eligible for cleanup under the Superfund program. Sites on the NPL are considered the most highly contaminated and undergo longer-term remedial investigation and remedial action (cleanups). The state of New Jersey, the fifth smallest state in the U.S., is the location of about ten percent of the priority Superfund sites, a disproportionate amount.
The Toxic Substances Control Act (TSCA) is a United States law, passed by the 94th United States Congress in 1976 and administered by the United States Environmental Protection Agency (EPA), that regulates chemicals not regulated by other U.S. federal statutes, including chemicals already in commerce and the introduction of new chemicals. When the TSCA was put into place, all existing chemicals were considered to be safe for use and subsequently grandfathered in. Its three main objectives are to assess and regulate new commercial chemicals before they enter the market, to regulate chemicals already existing in 1976 that posed an "unreasonable risk of injury to health or the environment", as for example PCBs, lead, mercury and radon, and to regulate these chemicals' distribution and use.
The Emergency Planning and Community Right-to-Know Act of 1986 is a United States federal law passed by the 99th United States Congress located at Title 42, Chapter 116 of the U.S. Code, concerned with emergency response preparedness.
Pollution prevention (P2) is a strategy for reducing the amount of waste created and released into the environment, particularly by industrial facilities, agriculture, or consumers. Many large corporations view P2 as a method of improving the efficiency and profitability of production processes through waste reduction and technology advancements. Legislative bodies have enacted P2 measures, such as the Pollution Prevention Act of 1990 and the Clean Air Act Amendments of 1990 in the United States Congress.
High production volume chemicals are produced or imported into the United States in quantities of 1 million pounds or 500 tons per year. In OECD countries, HPV chemicals are defined as being produced at levels greater than 1,000 metric tons per producer/importer per year in at least one member country/region. A list of HPV chemicals serves as an overall priority list, from which chemicals are selected to gather data for a screening information dataset (SIDS), for testing and for initial hazard assessment.
The Facility Registry System (FRS) is a centrally managed Environmental Protection Agency (EPA) database that identifies facilities, sites or places of environmental interest in the United States.
Title 40 is a part of the United States Code of Federal Regulations. Title 40 arranges mainly environmental regulations that were promulgated by the US Environmental Protection Agency (EPA), based on the provisions of United States laws. Parts of the regulation may be updated annually on July 1.
Inform, Inc. is a non-profit environmental organization based in New York City. Founded in 1973, Inform has published more than 100 reports covering chemical hazard prevention, solid waste prevention, extended producer responsibility, and sustainable transportation. Inform uses media, such as video, to educate the public about the environmental effects of various consumer products.
To protect the environment from the adverse effects of pollution, many nations worldwide have enacted legislation to regulate various types of pollution as well as to mitigate the adverse effects of pollution. At the local level, regulation usually is supervised by environmental agencies or the broader public health system. Different jurisdictions often have different levels regulation and policy choices about pollution. Historically, polluters will lobby governments in less economically developed areas or countries to maintain lax regulation in order to protect industrialisation at the cost of human and environmental health.
A Discharge Monitoring Report (DMR) is a United States regulatory term for a periodic water pollution report prepared by industries, municipalities and other facilities discharging to surface waters. The facilities collect wastewater samples, conduct chemical and/or biological tests of the samples, and submit reports to a state agency or the United States Environmental Protection Agency (EPA). All point source dischargers to ”Waters of the U.S.” must obtain a National Pollution Discharge Elimination System (NPDES) permit from the appropriate agency, and many permittees are required to file DMRs.
The environmental effects of paper are significant, which has led to changes in industry and behaviour at both business and personal levels. With the use of modern technology such as the printing press and the highly mechanized harvesting of wood, disposable paper became a relatively cheap commodity, which led to a high level of consumption and waste. The rise in global environmental issues such as air and water pollution, climate change, overflowing landfills and clearcutting have all lead to increased government regulations. There is now a trend towards sustainability in the pulp and paper industry as it moves to reduce clear cutting, water use, greenhouse gas emissions, fossil fuel consumption and clean up its influence on local water supplies and air pollution.
Water quality laws govern the protection of water resources for human health and the environment. Water quality laws are legal standards or requirements governing water quality, that is, the concentrations of water pollutants in some regulated volume of water. Such standards are generally expressed as levels of a specific water pollutants that are deemed acceptable in the water volume, and are generally designed relative to the water's intended use - whether for human consumption, industrial or domestic use, recreation, or as aquatic habitat. Additionally, these laws provide regulations on the alteration of the chemical, physical, radiological, and biological characteristics of water resources. Regulatory efforts may include identifying and categorizing water pollutants, dictating acceptable pollutant concentrations in water resources, and limiting pollutant discharges from effluent sources. Regulatory areas include sewage treatment and disposal, industrial and agricultural waste water management, and control of surface runoff from construction sites and urban environments. Water quality laws provides the foundation for regulations in water standards, monitoring, required inspections and permits, and enforcement. These laws may be modified to meet current needs and priorities.
Water pollution in the United States is a growing problem that became critical in the 19th century with the development of mechanized agriculture, mining, and industry, although laws and regulations introduced in the late 20th century have improved water quality in many water bodies. Extensive industrialization and rapid urban growth exacerbated water pollution as a lack of regulation allowed for discharges of sewage, toxic chemicals, nutrients and other pollutants into surface water.
Solid waste policy in the United States is aimed at developing and implementing proper mechanisms to effectively manage solid waste. For solid waste policy to be effective, inputs should come from stakeholders, including citizens, businesses, community-based organizations, non-governmental organizations, government agencies, universities, and other research organizations. These inputs form the basis of policy frameworks that influence solid waste management decisions. In the United States, the Environmental Protection Agency (EPA) regulates household, industrial, manufacturing, and commercial solid and hazardous wastes under the 1976 Resource Conservation and Recovery Act (RCRA). Effective solid waste management is a cooperative effort involving federal, state, regional, and local entities. Thus, the RCRA's Solid Waste program section D encourages the environmental departments of each state to develop comprehensive plans to manage nonhazardous industrial and municipal solid waste.
Mercury regulation in the United States limit the maximum concentrations of mercury (Hg) that is permitted in air, water, soil, food and drugs. The regulations are promulgated by agencies such as the Environmental Protection Agency (EPA) and Food and Drug Administration (FDA), as well as a variety of state and local authorities. EPA published the Mercury and Air Toxics Standards (MATS) regulation in 2012; the first federal standards requiring power plants to limit emissions of mercury and other toxic gases.
The Pollution Prevention Act of 1990 (PPA) is a United States federal law that created a national policy to promote the prevention of pollution or reduction at pollution sources wherever possible. The law also expanded the Toxics Release Inventory (TRI), a waste reporting program administered by the United States Environmental Protection Agency (EPA).
There are many exemptions for fracking under United States federal law: the oil and gas industries are exempt or excluded from certain sections of a number of the major federal environmental laws. These laws range from protecting clean water and air, to preventing the release of toxic substances and chemicals into the environment: the Clean Air Act, Clean Water Act, Safe Drinking Water Act, National Environmental Policy Act, Resource Conservation and Recovery Act, Emergency Planning and Community Right-to-Know Act, and the Comprehensive Environmental Response, Compensation, and Liability Act, commonly known as Superfund.
