Cox v. New Hampshire, 312 U.S. 569 (1941), was a case in which the Supreme Court of the United States held that, although the government cannot regulate the contents of speech, it can place reasonable time, place, and manner restrictions on speech for the public safety. [1] Here, the Court held that government may require organizers of any parade or procession on public streets to have a license and pay a fee.

Sixty-eight Jehovah's Witnesses had assembled at their church and divided into smaller groups that marched along sidewalks, displaying signs, and handing out leaflets advertising a meeting. During the march, groups of 15 to 20 people marched in single file down sidewalks in the district, interfering with hard foot travel.

In 1941, all 68 Jehovah's Witnesses were convicted in a New Hampshire municipal court for violating a state statute which prohibited parades and processions on public streets without a license. The defendants claimed that their First Amendment rights were violated including their rights to freedom of worship and freedom of assembly.

Decision of the Court

Does the New Hampshire state statute that prohibits unlicensed parades violate the First Amendment's guarantees of freedom of speech and assembly as applied to the states by the Fourteenth Amendment?

No. Chief Justice Charles E. Hughes delivered the opinion for the unanimous Court. The Court held that a municipality's ability to impose regulations that create order and safety for its populace does not infringe on the civil liberties of its people. Because the statute in question only grants a town selectman or licensing board the limited authority to ensure that a proposed parade will not interfere with the proper uses of streets, there is not opportunity for it to wield undue or arbitrary power that would infringe on constitutional rights. The Court also held that there was no evidence that the statute had been administered unfairly in this case.

Effects of the decision

Prior to the decision in Cox, the U.S. Supreme Court had struck down, under the First and Fourteenth Amendments, numerous ordinances imposing permit requirements on expressive activity in public places, such as streets and parks, because the ordinances gave government officials unlimited discretion whether to issue the permits. After Cox, local governments were allowed to regulate competing uses of public forums by using a permit scheme to impose reasonable time, place, and manner restrictions on those wishing to hold a march, parade, or rally.

The decision established the right of local governments to require a permit to conduct a parade or procession upon a public street. However, permit decisions had to be made according to uniform, nondiscriminatory standards based upon public convenience and safety to satisfy the Fourteenth Amendment. Because governments face greater costs in policing and overseeing parades, they are allowed to pass some expenses on to the groups conducting the events - and hence also have some regulatory power over the events.

Requiring licenses was thus found to be entirely consistent with also allowing time and place restrictions to prevent a public inconvenience. Validating permit requirements for parades meant that local governments received advance notice of parades allowing them the opportunity to plan policing activities to minimize disorder and inconvenience to passersby.

In addition, Cox allowed local governments to give a different degree of protection under the First and Fourteenth Amendments to those who communicated ideas by patrolling, marching, and picketing on streets and highways and those who communicated ideas by pure speech. Permit systems were deemed constitutionally valid so long as the discretion of the issuing official was limited to questions of times, places, and manners, and was not based on the content of the message. The reasonable time, place and manner restriction of Cox was subsequently applied to government attempts to regulate a wide range of religious, social, economic, and political activity.

In the United States, freedom of speech and expression is strongly protected from government restrictions by the First Amendment to the U.S. Constitution, many state constitutions, and state and federal laws. Freedom of speech, also called free speech, means the free and public expression of opinions without censorship, interference and restraint by the government. The term "freedom of speech" embedded in the First Amendment encompasses the decision what to say as well as what not to say. The Supreme Court of the United States has recognized several categories of speech that are given lesser or no protection by the First Amendment and has recognized that governments may enact reasonable time, place, or manner restrictions on speech. The First Amendment's constitutional right of free speech, which is applicable to state and local governments under the incorporation doctrine, prevents only government restrictions on speech, not restrictions imposed by private individuals or businesses unless they are acting on behalf of the government. However, It can be restricted by time, place and manner in limited circumstances. Some laws may restrict the ability of private businesses and individuals from restricting the speech of others, such as employment laws that restrict employers' ability to prevent employees from disclosing their salary to coworkers or attempting to organize a labor union.

Forsyth County, Georgia v. The Nationalist Movement, 505 U.S. 123 (1992), was a case in which the United States Supreme Court limited the ability of local governments to charge fees for the use of public places for private activities. By a 5–4 vote, the court ruled that an ordinance allowing the local government to set varying fees for different events violated the First Amendment due to the lack of "narrowly drawn, reasonable, and definite standards" governing the amount of the fee.

Rust v. Sullivan, 500 U.S. 173 (1991), was a case in the United States Supreme Court that upheld Department of Health and Human Services regulations prohibiting employees in federally funded family-planning facilities from counseling a patient on abortion. The department had removed all family planning programs that involving abortions. Physicians and clinics challenged this decision within the Supreme Court, arguing that the First Amendment was violated due to the implementation of this new policy. The Supreme Court, by a 5–4 verdict, allowed the regulation to go into effect, holding that the regulation was a reasonable interpretation of the Public Health Service Act, and that the First Amendment is not violated when the government merely chooses to "fund one activity to the exclusion of another."

Virginia v. Black, 538 U.S. 343 (2003), was a landmark decision of the Supreme Court of the United States in which the Court held, 5–4, that any state statute banning cross burning on the basis that it constitutes prima facie evidence of intent to intimidate is a violation of the First Amendment to the Constitution. Such a provision, the Court argued, blurs the distinction between proscribable "threats of intimidation" and the Ku Klux Klan's protected "messages of shared ideology". In the case, three defendants were convicted in two separate cases of violating a Virginia statute against cross burning. However, cross-burning can be a criminal offense if the intent to intimidate is proven. It was argued by former Solicitor General of Virginia, William Hurd.

Marsh v. Alabama, 326 U.S. 501 (1946), was a case decided by the US Supreme Court, which ruled that a state trespassing statute could not be used to prevent the distribution of religious materials on a town's sidewalk even though the sidewalk was part of a privately-owned company town. In the United States, open carry refers to the practice of visibly carrying a firearm in public places, as distinguished from concealed carry, where firearms cannot be seen by the casual observer. To "carry" in this context indicates that the firearm is kept readily accessible on the person, within a holster or attached to a sling. Posadas de Puerto Rico Associates v. Tourism Co. of Puerto Rico, 478 U.S. 328 (1986), was a 1986 appeal to the Supreme Court of the United States to determine whether Puerto Rico's Games of Chance Act of 1948 is in legal compliance with the United States Constitution, specifically as regards freedom of speech, equal protection and due process. In a 5–4 decision, the Supreme Court held that the Puerto Rico government (law) could restrict advertisement for casino gambling from being targeted to residents, even if the activity itself was legal and advertisement to tourists was permitted. The U.S. Supreme Court affirmed the Puerto Rico Supreme Court conclusion, as construed by the Puerto Rico Superior Court, that the Act and regulations do not facially violate the First Amendment, nor did it violate the due process or Equal Protection Clauses of the Fourteenth Amendment.

<span class="mw-page-title-main">Street performing (U.S. case law)</span>

In the United States there have been numerous legal cases about regulations and laws that have decided the rights of street performers to perform in public. Most of these laws and regulations have been found to be unconstitutional when challenged. In the US, free speech is considered a fundamental right of every individual, guaranteed by the First and Fourteenth constitutional amendments, and in the majority of legal cases it has been concluded that practicing artistic free speech is legal. Street performing is legally considered to be artistic free speech and is protected, just as is panhandling or begging.

Sorrell v. IMS Health Inc., 564 U.S. 552 (2011), is a United States Supreme Court case in which the Court held that a Vermont statute that restricted the sale, disclosure, and use of records that revealed the prescribing practices of individual doctors violated the First Amendment.

<i>Anderson v. City of Hermosa Beach</i>

Anderson v. City of Hermosa Beach, 621 F. 3d 1051 (2010), was a decision by the U.S. Court of Appeals for the Ninth Circuit, which ruled that tattoos, the process of tattooing, and the business of tattooing are pure expressive activities that are fully protected by the First Amendment's free speech clause. The court determined that the process of tattooing constitutes pure expressive activity rather than conduct that is sufficiently imbued with elements of communication. As pure expressive activity, the process of tattooing can only be regulated by a proper time, place, and manner restriction. The court found in Anderson v. The City of Hermosa Beach that the Hermosa Beach Municipal Code banning tattoo parlors within the city was not a reasonable time, place, and manner restriction because the regulation was not narrowly tailored to meet the government's interest and the regulation did not leave open ample alternative avenues for the same messages to be conveyed.
