United States v. Albertini, 472 U.S. 675 (1985), was a United States Supreme Court case about the First Amendment rights of a man who had been banned from entering a military base and later entered the base where he participated in a protest. According to the court, the base did not become a public forum just because it was holding an open house at the time. The court held that the government's interest in securing military bases justified excluding people who had been ordered not to reenter. This First Amendment holding applied a version of the test from United States v. O'Brien (1968) for content-neutral incidental burdens on speech.
In 1972, James Albertini entered Hickam Air Force Base in Hawaii and destroyed military documents there. He was convicted for the crime. In addition, the commander of the base issued him a "bar letter" which prohibited him from entering the base again. [1]
Nine years later, in 1981, Albertini reentered Hickam during its annual Armed Forces Day open house. The open house invited the general public to visit the base, which was normally closed to the public. At the open house, Albertini and his companions peacefully protested against the nuclear arms race. Military police removed them from the base. [1]
Albertini was convicted of the crime of reentering a military base after having been ordered not to. The conviction was reversed by the U.S. Court of Appeals for the Ninth Circuit, which held that the open house was a temporary public forum and that excluding him from the forum violated the First Amendment. [2] The government petitioned to the Supreme Court, which agreed to hear the case. [1]
The Supreme Court decided that Albertini's conviction did not violate the First Amendment.
Justice Sandra Day O'Connor wrote for a six-justice majority. The court first determined that the criminal statute covered Albertini's conduct. Rejecting several of Albertini's arguments, the court found that his exclusion from the base did not have an implicit time limit, that open houses were still subject to the statute, and that the statute did not require a knowing violation of the bar letter.
Turning to the First Amendment arguments, the court reiterated that military bases ordinarily are not public forums, citing Greer v. Spock (1976). The court held that the open house did not temporarily turn the base into a public forum just because the open house was used for communication.
Even if the open house was a public forum, the court found that the statute was content-neutral, subjecting it to the test of United States v. O'Brien (1968) for incidental burdens on speech. Here, the burden was "no greater than is essential" and "the neutral regulation promotes a substantial government interest that would be achieved less effectively absent the regulation". [3] The criminal prosecution was not because of speech, but because of unlawful entry to the base. The court concluded that this validly served the government's interest in the security of military bases.
Justice John Paul Stevens dissented, joined by Brennan and Marshall. Stevens argued that the circumstances reasonably permitted Albertini's entry. The statute was not meant to punish a visit to the base when the open house welcomed him to visit. Stevens disagreed with the majority for interpreting the text too literally to create strict liability beyond what Congress intended.
Commentators saw Albertini as weakening the test the court applies for neutral and incidental burdens on speech. According to law professor David S. Day, Albertini used the O'Brien test in a way such that "the not greater than necessary prong was not the equivalent of a least restrictive alternative analysis". [4] He concluded that Albertini, along with Wayte v. United States earlier the same year, effectively "reduced the means scrutiny to the rational basis level". [5] A law review article by Carney R. Shegerian highlighted how a later case Ward v. Rock Against Racism (1989) "gave the narrowly tailored requirement little, if any, force" by relying on language from Albertini along with Clark v. Community for Creative Non-Violence (1984). [6]
Scholars found it difficult to interpret Albertini's place in First Amendment doctrine after Arcara v. Cloud Books, Inc. (1986). Arcara was a later First Amendment case about closing a bookstore because of illicit sexual activities occurring there. The court applied no First Amendment scrutiny to the effect of the forced closure, distinguishing O'Brien and Albertini because the prohibited sexual activities had no expressive element. Scholars questioned this reasoning: Albertini was also punished for nonexpressive conduct – reentry to the base – not for his subsequent protest. [7] In First Amendment scholar Geoffrey R. Stone's view, Albertini meant either that there were exceptions to Arcara not recognized there, or that "expressive" activity could be very broad. [8] A law review article by Sri Srinivasan (who later became a D.C. Circuit judge) interpreted Albertini as an exception to Arcara. [9] Constitutional law scholar Wesley Jud Campbell argued that "the Court's method of decision in Albertini simply does not reflect current doctrine following Arcara." [10]
In the United States, freedom of speech and expression is strongly protected from government restrictions by the First Amendment to the U.S. Constitution, many state constitutions, and state and federal laws. Freedom of speech, also called free speech, means the free and public expression of opinions without censorship, interference and restraint by the government The term "freedom of speech" embedded in the First Amendment encompasses the decision what to say as well as what not to say. The Supreme Court of the United States has recognized several categories of speech that are given lesser or no protection by the First Amendment and has recognized that governments may enact reasonable time, place, or manner restrictions on speech. The First Amendment's constitutional right of free speech, which is applicable to state and local governments under the incorporation doctrine, prevents only government restrictions on speech, not restrictions imposed by private individuals or businesses unless they are acting on behalf of the government. The right of free speech can, however, be lawfully restricted by time, place and manner in limited circumstances. Some laws may restrict the ability of private businesses and individuals from restricting the speech of others, such as employment laws that restrict employers' ability to prevent employees from disclosing their salary to coworkers or attempting to organize a labor union.
Symbolic speech is a legal term in United States law used to describe actions that purposefully and discernibly convey a particular message or statement to those viewing it. Symbolic speech is recognized as being protected under the First Amendment as a form of speech, but this is not expressly written as such in the document. One possible explanation as to why the Framers did not address this issue in the Bill of Rights is because the primary forms for both political debate and protest in their time were verbal expression and published word, and they may have been unaware of the possibility of future people using non-verbal expression. Symbolic speech is distinguished from pure speech, which is the communication of ideas through spoken or written words or through conduct limited in form to that necessary to convey the idea.
First National Bank of Boston v. Bellotti, 435 U.S. 765 (1978), is a U.S. constitutional law case which defined the free speech right of corporations for the first time. The United States Supreme Court held that corporations have a First Amendment right to make contributions to ballot initiative campaigns. The ruling came in response to a Massachusetts law that prohibited corporate donations in ballot initiatives unless the corporation's interests were directly involved.
United States v. O'Brien, 391 U.S. 367 (1968), was a landmark decision of the United States Supreme Court, ruling that a criminal prohibition against burning a draft card did not violate the First Amendment's guarantee of free speech. Though the court recognized that O'Brien's conduct was expressive as a protest against the Vietnam War, it considered the law justified by a significant government interest unrelated to the suppression of speech and was tailored towards that end.
Virginia v. Black, 538 U.S. 343 (2003), was a landmark decision of the Supreme Court of the United States in which the Court held, 5–4, that any state statute banning cross burning on the basis that it constitutes prima facie evidence of intent to intimidate is a violation of the First Amendment to the Constitution. Such a provision, the Court argued, blurs the distinction between proscribable "threats of intimidation" and the Ku Klux Klan's protected "messages of shared ideology". In the case, three defendants were convicted in two separate cases of violating a Virginia statute against cross burning. However, cross-burning can be a criminal offense if the intent to intimidate is proven. It was argued by former Solicitor General of Virginia, William Hurd and Rodney A. Smolla.
Intermediate scrutiny, in U.S. constitutional law, is the second level of deciding issues using judicial review. The other levels are typically referred to as rational basis review and strict scrutiny.
In the Constitutional law of the United States, a forum is a property that is open to public expression and assembly.
Barnes v. Glen Theatre, Inc., 501 U.S. 560 (1991), was a landmark decision of the U.S. Supreme Court concerning the First Amendment and the ability of the government to outlaw certain forms of expressive conduct. It ruled that the state has the constitutional authority to ban public nudity, even as part of expressive conduct such as dancing, because it furthers a substantial government interest in protecting the morality and order of society. This case is perhaps best summarized by a sentence in Justice Souter's concurring opinion, which is often paraphrased as "Nudity itself is not inherently expressive conduct."
Erie v. Pap's A. M., 529 U.S. 277 (2000), was a landmark decision by the Supreme Court of the United States regarding nude dancing as free speech. The court held that an ordinance banning public nudity did not violate the operator of a totally nude entertainment establishment's constitutional right to free speech.
Cox v. New Hampshire, 312 U.S. 569 (1941), was a case in which the Supreme Court of the United States held that, although the government cannot regulate the contents of speech, it can place reasonable time, place, and manner restrictions on speech for the public safety. Here, the Court held that government may require organizers of any parade or procession on public streets to have a license and pay a fee.
Roberts v. United States Jaycees, 468 U.S. 609 (1984), was a decision of the Supreme Court of the United States overturning the United States Court of Appeals for the Eighth Circuit's application of a Minnesota antidiscrimination law. The case established what was at the time the prevailing framework for analyzing claims of associative freedom, holding that the Minneapolis branch of the United States Jaycees could not bar women from becoming voting members.
United States v. American Library Association, 539 U.S. 194 (2003), was a decision in which the United States Supreme Court ruled that the United States Congress has the authority to require public schools and libraries receiving E-Rate discounts to install web filtering software as a condition of receiving federal funding. In a plurality opinion, the Supreme Court ruled that public school and library usage of Internet filtering software does not violate their patrons' First Amendment free speech rights and that the Children's Internet Protection Act is not unconstitutional.
Legal Services Corp. v. Velazquez, 531 U.S. 533 (2001), is a decision of the Supreme Court of the United States concerning the constitutionality of funding restrictions imposed by the United States Congress. At issue were restrictions on the Legal Services Corporation (LSC), a private, nonprofit corporation established by Congress. The restrictions prohibited LSC attorneys from representing clients attempting to amend existing welfare law. The case was brought by Carmen Velazquez, whose LSC-funded attorneys sought to challenge existing welfare provisions since they believed that it was the only way to get Velazquez financial relief.
Sorrell v. IMS Health Inc., 564 U.S. 552 (2011), is a United States Supreme Court case in which the Court held that a Vermont statute that restricted the sale, disclosure, and use of records that revealed the prescribing practices of individual doctors violated the First Amendment.
Clark v. Community for Creative Non-Violence, 468 U.S. 288 (1984), is a United States Supreme Court case with the National Park Service's regulation which specifically prohibited sleeping in Lafayette Park and the National Mall at issue. The Community for Creative Non-Violence (CCNV) group had planned to hold a demonstration on the National Mall and Lafayette Park where they would erect tent cities to raise awareness of the situation of the homeless. The group obtained the correct permits for a seven-day demonstration starting on the first day of winter. The Park Service however denied the request that participants be able to sleep in the tents. The CCNV challenged this regulation on the basis that it violated their First Amendment right.
Nevada Commission on Ethics v. Carrigan, 564 U.S. 117 (2011), was a Supreme Court of the United States decision in which the court held that the Nevada Ethics in Government Law, which required government officials recuse in cases involving a conflict of interest, is not unconstitutionally overbroad. Specifically, the law requires government officials to recuse themselves from advocating for and voting on the passage of legislation if private commitments to the interests of others materially affect the official's judgment. Under the terms of this law, the Nevada Commission on Ethics censured city councilman Michael Carrigan for voting on a land project for which his campaign manager was a paid consultant. Carrigan challenged his censure in court and the Nevada Supreme Court ruled in his favor, claiming that casting his vote was protected speech. The Supreme Court reversed, ruling that voting by a public official on a public matter is not First Amendment speech.
Anderson v. City of Hermosa Beach, 621 F. 3d 1051 (2010), was a decision by the U.S. Court of Appeals for the Ninth Circuit, which ruled that tattoos, the process of tattooing, and the business of tattooing are pure expressive activities that are fully protected by the First Amendment's free speech clause. The court determined that the process of tattooing constitutes pure expressive activity rather than conduct that is sufficiently imbued with elements of communication. As pure expressive activity, the process of tattooing can only be regulated by a proper time, place, and manner restriction. The court found in Anderson v. The City of Hermosa Beach that the Hermosa Beach Municipal Code banning tattoo parlors within the city was not a reasonable time, place, and manner restriction because the regulation was not narrowly tailored to meet the government's interest and the regulation did not leave open ample alternative avenues for the same messages to be conveyed.
Perry Education Association v. Perry Local Educators' Association, 460 U.S. 37 (1983), was a United States Supreme Court decision concerning free speech rights on government-owned property. The Court ruled that teacher mailboxes and the use of a school mail delivery system are a nonpublic forum, and upheld a policy that allowed the union representing the teachers, but not other employee organizations, to use the district's mail system.
Lehman v. City of Shaker Heights, 418 U.S. 298 (1974), was a case in which the United States Supreme Court upheld a city's ban on political advertising within its public transportation system. The Court ruled that ad space on public transit is not a "public forum", meaning that speech within this space receives lower First Amendment protections.
Arcara v. Cloud Books, Inc., 478 U.S. 697 (1986), was a United States Supreme Court case about the First Amendment and whether freedom of speech was violated by shutting down a bookstore because of illicit sexual activities occurring there. The court held that the closure was aimed at nonexpressive activity and its incidental burden on speech was not subject to any First Amendment scrutiny.
