On May 18, 2017, a car was crashed in Times Square, New York City, United States. One person was killed and 20 were injured. Navy veteran Richard Rojas was charged with one count of second degree murder, 18 attempted murders and 38 assaults, for which he was found not responsible because of insanity.

After being detained, Rojas was found to have ingested phencyclidine before the crash. When interviewed by the NYPD, Rojas said he wanted to die in a "suicide by cop", and that he had been hearing voices. In a jailhouse news interview three days later, he said he did not remember the incident or any statements he made afterward.

A year later, multiple liability lawsuits were filed between Rojas, victims, and the city.

Incident

Richard Rojas, the driver of a maroon 2009 Honda Accord, sped into pedestrians in Times Square after having jumped the sidewalk on the west side of Seventh Avenue at 42nd Street, [2] [3] outside the Reuters Building. [4] He continued for three blocks before crashing into traffic bollards at the northwest corner of 45th Street and Seventh Avenue, at Broadway. [2] [3] As Rojas was trying to leave his car, a traffic agent tackled him and took him into custody. [3] After having exited the car Rojas said: "I wanted to kill them," according to prosecutors. [5]

Victims

Alyssa Elsman, an 18-year-old tourist from Portage, Michigan, was killed and 20 people were injured, four critically. [4] [6] [7]

Suspect

Richard Rojas (born 1991), a 26-year-old resident of the Bronx and a military veteran, was arrested and charged after the crash. [8] He previously served in the United States Navy and had two prior arrests for driving under the influence. [9] These arrests came in 2008 and 2015. [2] He enlisted in the Navy in 2011 and was an electrician's mate fireman apprentice. In 2012, he served aboard the destroyer USS Carney. He was most recently based at Naval Air Station Jacksonville and was discharged in 2014. [10]

Rojas was arrested in September 2012 after assaulting a cab driver and yelling at an officer, "My life is over", and threatening to kill police officers after his release. He also spent two months in military prison in 2013. A neighbor said his family was Dominican. [11] [12] One of his friends said Rojas had developed a drinking problem after his military service, using it as medication for his "dark thoughts and moods", [13] and posted what the friend described as "demonic" content on social media. [14] According to authorities and his friends, his mental health issues dated back to his childhood though he never sought psychiatric care, becoming more paranoid and increasing his intake of marijuana and alcohol. [15]

Rojas was obsessed with Scientology and had accumulated literature on the religion. He recently got back his car after it was repossessed a short time before the incident. [16] A week before the incident, he was arrested and charged with pointing a knife at a notary, whom he accused of stealing his identity. [10]

Investigators looked into his psychological history. [1] In an interview for the New York Post on May 21, he said he had no recollection of the incident or any statements he made when arrested and sought help in the prior week, including speaking to a mental health counselor at a veteran's affairs center, who promised to call him on Monday (May 22). [17]

Aftermath

Bill de Blasio, the Mayor of New York City, and other officials have said there is no indication the incident was an act of terrorism. [2] Several law enforcement officials said the suspect thought he was hearing voices and expected to die. Rojas tested negative for alcohol, but additional testing was done to determine whether he was taking any drugs. [10] The drug test came back as positive while blood tests were conducted for whether he had taken synthetic marijuana or PCP. [18] Rojas has since offered alternative explanations to the investigators who said they hadn't come to any conclusions. [3]

According to a criminal complaint, Rojas admitted smoking marijuana laced with PCP before driving the car. Prosecutors said he told the police he wanted to die by suicide by cop. He also rambled that he had been hearing voices and it was the last day on Earth. [19] According to other sources, he said he claimed to hear voices telling him the police were going to kill him. [20] Later, they said he had tested positive for PCP and told police God made him do it. [3] His interview was said to be abnormal and rambling. [20]

Rojas was later charged with second-degree murder, 20 counts of attempted murder, and five counts of aggravated vehicular homicide. [21] On July 13, Rojas, through his lawyer, Enrico DeMarco, pleaded not guilty to two counts of second-degree murder, 18 attempted murders and 38 assaults. [22]

On October 24, DeMarco declined to reveal whether he would attempt an insanity defense, saying he needed "another month or so" to examine Rojas' possessions, such as notebooks, which the district attorney possesses. Justice Melissa Jackson urged him to hurry before adjourning until December 18. [23] On December 17, he filed notice of his intent to pursue an insanity defense. Rojas was examined by psychiatrists hired by both sides. [24] Jury selection began on April 18, 2022, five years after the attack. If Rojas was convicted of all charges, he would have faced a life sentence. [25]

Defense psychiatrist Dr. Ziv Cohen from Weill Cornell Medicine at Columbia University testified that Rojas had schizophrenia, and had begun hearing voices while in the navy. Cohen testified that "At a certain point, the psychosis becomes so severe that he can't control his behavior anymore." [26] It was one of these voices that told Rojas on the day of the attack to crash his car. [26] [27] [28] On June 22, the jury found Rojas not responsible because of insanity. [29]

Civil action

In June 2017, attorney Greg Sobo of Sobo & Sobo L.L.P. was hired to represent Alyssa and her father Thomas Elsman, as well as several other relatives and survivors of the incident in a case against Rojas. [30] [31] In July 2018, Sobo filed a second claim against New York City for unspecified damages, alleging that the city failed to provide adequate protection from civilian attacks. [32] The claimants include Thomas Elsman, as well as victims Gayatari Jariwala, William McCollough, Destiny Lightfoot, and Caroline Jacobs. [33] The next month, victims Jessica Williams and William Nelson Sr. filed a similar joint suit for $75 million. [34]

Rojas was also named as a defendant against the city. [35] He countersued the plaintiffs, blaming their injuries on their own culpable conduct, and holding their respective insurance companies solely responsible for paying their expenses. He agreed with their claim that the city was recklessly negligent, and sued it accordingly. [36]

On July 2, 2008, an Arab resident of East Jerusalem identified as Hussam Taysir Duwait attacked several cars on Jaffa Road in Jerusalem in a vehicle-ramming attack using a front-end loader, killing three civilians and wounding at least thirty other pedestrians, before being shot to death. Israeli government spokesman Mark Regev said that an inquiry indicated the attacker had been acting alone. A motive for the attack could not immediately be determined, but police at the scene referred to the incident as a terrorist attack. Three copycat attacks have occurred since then.

On September 29, 2013, motorist Alexian Lien was assaulted while driving on the Henry Hudson Parkway in New York City. Lien had gotten into an altercation with motorcyclists who were participating in a rally called Hollywood's Block Party. One of the bikers pulled in front of Lien and slowed dramatically. Lien said that he struck the bike from behind, stopped his vehicle, and was quickly surrounded by bikers, who began attacking his SUV. He testified that he feared for his life so he accelerated, running over several bikes and striking one of the bikers, paralyzing him. A chase ensued, ending in Lien being pulled from his vehicle and beaten. The media later reported that the involved bikers were members of a loose association of high-performance motorcycle enthusiasts known as "Hollywood Stuntz" who had previously been observed and filmed engaging in reckless driving and threatening motorists.

On 28 October 2013, a car ran over pedestrians and crashed in Tiananmen Square, Beijing, China, in a terrorist suicide attack. Five people died in the incident; three inside the vehicle and two others nearby. Police identified the driver as Usmen Hasan and the two passengers as his wife, Gulkiz Gini, and his mother, Kuwanhan Reyim. An additional 38 people were injured.

During the evening rush hour on August 24, 1928, an express subway train derailed immediately after leaving the Times Square station on the IRT Broadway–Seventh Avenue Line. Sixteen people were killed at the scene, two died later, and about 100 were injured. It remains the second-deadliest accident on the New York City Subway system, after the Malbone Street Wreck.

A vehicle-ramming attack, also known as a vehicle as a weapon or VAW attack, is an assault in which a perpetrator deliberately rams a vehicle into a building, people, or another vehicle. According to Stratfor Global Intelligence analysts, this attack represents a relatively new militant tactic that could prove more difficult to prevent than suicide bombings.

On 22 December 2014 a bin lorry collided with pedestrians in the city centre of Glasgow, Scotland, killing six and injuring fifteen others. The driver of the council-owned vehicle, Harry Clarke, said he had passed out at the wheel. A similar blackout had happened to him in the driving seat of a bus. He had not disclosed that incident on his heavy goods vehicle licence renewal application, despite such self-reporting being mandatory. Clarke was officially told he would not face further prosecution, causing protests from victims' families at the way the case had been handled.

The driver of the vehicle, James "Dimitrious" Gargasoulas, who was in a drug-induced psychosis, was subsequently found guilty of six counts of murder and was sentenced to life in prison with a non-parole period of 46 years.

On 19 June 2017, an Islamophobic terrorist attack occurred in Finsbury Park, London, England, when a van was intentionally driven into a crowd of Muslim pedestrians near the Muslim Welfare House, 100 yards (90 m) from the Finsbury Park Mosque, causing 1 death and injuring 11 people. The attack was found to be motivated by Islamophobia.

On 21 December 2017, at 4:41 pm AEDT, a driver rammed pedestrians with his car at the corner of Flinders Street and Elizabeth Street in Melbourne, Victoria, Australia, killing one person and injuring seventeen others, including himself. The sole fatality, an elderly man, died eight days after the attack.

The death of Elaine Herzberg was the first recorded case of a pedestrian fatality involving a self-driving car, after a collision that occurred late in the evening of March 18, 2018. Herzberg was pushing a bicycle across a four-lane road in Tempe, Arizona, United States, when she was struck by an Uber test vehicle, which was operating in self-drive mode with a human safety backup driver sitting in the driving seat. Herzberg was taken to the local hospital where she died of her injuries.

The Charlottesville car attack was a white supremacist terrorist attack perpetrated on August 12, 2017, when James Alex Fields Jr. deliberately drove his car into a crowd of people peacefully protesting the Unite the Right rally in Charlottesville, Virginia, killing one person and injuring 35. Fields, 20, had previously espoused neo-Nazi and white supremacist beliefs, and drove from Ohio to attend the rally.

On 14 August 2018, three people were injured when a silver Ford Fiesta hit them near the Palace of Westminster, London, England. The car then went on to crash into the separation barrier of the pavement situated between St Margaret Street / Abingdon Street and Old Palace Yard. The Metropolitan Police responded within seconds and arrested the driver, Salih Khater, without further incident. An ambulance immediately behind the Ford stopped and gave assistance to the injured. Khater was subsequently found guilty of two counts of attempted murder and sentenced to life in prison.

At 13:45 on 1 December 2020, a man rammed pedestrians with an SUV at high speed in a pedestrian zone in Trier, Rhineland-Palatinate, Germany, killing six people—a 45-year-old man and his infant daughter; a 77-year-old man; and three women aged 25, 52, and 73— and wounding 23 others. The driver, who was alone in the car and had a blood alcohol content of 0.14%, was arrested at the scene.

<span class="mw-page-title-main">2023 Guangzhou car attack</span> Mass murder in China

On 11 January 2023, the driver of a black BMW X3 deliberately rammed his vehicle into a crowd of pedestrians and motorists on Tianhe Road in Guangzhou, China, killing six people and injuring 29 others. 22-year-old Wen Qingyun was arrested in connection to the attack, sentenced to death, and subsequently executed on 19 April 2024.

On May 7, 2023, a Range Rover sport utility vehicle rammed into 18 people in Brownsville, Texas, United States. Eight people were killed, and ten were injured. Officials say it is unclear whether the crash was intentional.
