In general, a port of entry (POE) is a place where one may lawfully enter a country. It typically has border security staff and facilities to check passports and visas and to inspect luggage to assure that contraband is not imported. International airports are usually ports of entry, as are road and rail crossings on a land border. Seaports can be used as ports of entry only if a dedicated customs presence is posted there. The choice of whether to become a port of entry is up to the civil authority controlling the port.

Airport of entry

An airport of entry (AOE) is an airport that provides customs and immigration services for incoming flights. These services allow the airport to serve as an initial port of entry for foreign visitors arriving in a country.

Terminology

The word "international" in an airport's name usually means that it is an airport of entry, but many airports of entry do not use it. Airports of entry can range from large urban airports with heavy scheduled passenger service, like John F. Kennedy International Airport, to small rural airports serving general aviation exclusively. Often, smaller airports of entry are located near an existing port of entry such as a bridge or seaport.

On the other hand, however, some "former" airports of entry chose to leave their name with the word "international" in it, even though they no longer serve international flights. One example is Osaka International Airport. Even when it had ended all international services and became a purely domestic airport after the opening of Kansai International Airport in 1994, it kept its original name of "Osaka International Airport". Many airports in the nearby region have the same situation, like Taipei Songshan Airport. Songshan retained its official Chinese name, Taipei International Airport, after Chiang Kai-shek International Airport (now Taiwan Taoyuan International Airport) opened. Similar cases of transitions of international airports such as Seoul, Tokyo, Nagoya, Shanghai, Hong Kong, Bangkok, Tehran, etc.

For the European Union, flights between countries in the Schengen Area are considered domestic regarding passport and immigration check. Several international airports have only intra-Schengen flights. Several of these have occasional charter flights to foreign countries.

Stateless persons

Some cases of statelessness have occurred in airports of entry forcing people to live in the airport for an extended period. One of the most famous cases was that of Mehran Karimi Nasseri, an Iranian national who lived in the Charles de Gaulle Airport in France for approximately eighteen years after being denied entry into France and not having a country of origin to be returned to due to claiming his Iranian nationality had been revoked. Nasseri's experience was loosely adapted by two films, the 1993 film Tombés du ciel and the 2004 film The Terminal . [1] Zahra Kamalfar, an Iranian national who attempted to travel to Canada via Russia and Germany using forged documents, lived in the Sheremetyevo International Airport in Russia for eleven months before being granted refugee status by Canada to reunite with her family in Vancouver. [2]

In the United States

The formal definition of a port of entry in the United States is something entirely different. According to the Code of Federal Regulations, "the terms 'port' and 'port of entry' incorporate the geographical area under the jurisdiction of a port director."[ citation needed ] In other words, a port of entry may encompass an area that includes several border crossings, as well as some air and sea ports. This also means that not every border crossing is a port of entry. There are two reasons for this:

  1. Every port of entry must have a Port Director, which is a higher pay grade than a typical border inspector. The U.S. government has determined that some small border crossings do not need their own Port Directors. As a result, border outposts like Churubusco, Chateaugay and Fort Covington, New York are considered "stations" within the Trout River Port of Entry.[ citation needed ]
  2. Historically, many roads entering the U.S. had no border inspection station. Before September 11, 2001, it was permissible for persons entering the U.S. to do so at any point (including back roads or closed border stations), as long as they proceeded directly to an open border inspection station. In fact, the U.S. Customs Service and U.S. Immigration and Naturalization Service routinely rented property in houses, post offices, and storefronts far from the physical border, and people entering the U.S. were expected to travel to these locations without stopping so they could make their declarations. This policy has since changed, and most of the roads entering the U.S. at locations other than an open and staffed border inspection station have since been barricaded.[ citation needed ]

Variations

In some countries, immigration procedures are carried out by the armed forces rather than specific immigration officers. However, in most, the levying of duty on imports is still carried out by customs officers. Immigration clearance in some ports of entry have automated sections open to the country's own residents or citizens, such as the E-Channel found in Hong Kong and Macau, Global Entry found at some airports in the United States and other similar country-instituted programs.

On some international borders, the concept of a port of entry does not exist or is at least not applied to select countries of free-crossing pacts. Travelers may cross the border wherever and whenever convenient. For example, and as such a pact, most EU citizens may travel freely within the Schengen Area, which is made up entirely of EU member countries (though not all EU countries participate and thus are not within the Schengen Area). As with the example, in some cases, such free travel may be restricted to citizens of specific countries and to travelers who are not carrying goods over the customs limits; others may only cross the border at a designated border crossing during its opening times.

Land border checkpoints can be contrasted with the customs and immigration facilities at seaports, international airports, and other ports of entry.

Preclearance is the United States Department of Homeland Security's (DHS) practice of operating prescreening border control facilities at airports and other ports of departure located outside of the United States pursuant to agreements between the United States and host countries. Travelers are subject to immigration and customs inspections by Customs and Border Protection (CBP) officers before boarding their transportation onward to the United States. Preclearance applies to all passengers regardless of their nationality or purpose of travel. Upon arrival, precleared passengers arrive in the United States as domestic travelers, but may still be subject to re-inspection at the discretion of CBP. This process is intended to streamline border procedures, reduce congestion at American ports of entry, and facilitate travel into airports that otherwise lack immigration and customs processing facilities for commercial flights.

The Office of Field Operations (OFO) is a federal law enforcement agency within the U.S. Customs and Border Protection (CBP) responsible for managing United States customs operations at 20 Field Operations offices, 328 ports of entry, and 16 pre-clearance stations in Canada, Ireland, the UAE, and the Caribbean. Headed by an Executive Assistant Commissioner, OFO directs the activities of more than 27,000 employees, including more than 22,000 CBP Officers and Agriculture Specialists. CBP Office of Field Operations is the largest component in CBP.

<span class="mw-page-title-main">NEXUS</span> Trusted Traveler Program

NEXUS is a joint Canada Border Services Agency and U.S. Customs and Border Protection-operated Trusted Traveler and expedited border control program designed for pre-approved, low-risk travelers. Members of the program can avoid waits at border entry points by using reserved lanes at land crossings into Canada and the United States, by using self-serve kiosks at airports in Canada, the US and some international locations, or by phoning border officials for a marine entry. A NEXUS membership card is a valid document under the Western Hemisphere Travel Initiative (WHTI), so it can be used in place of a passport, including by air if flying between the US and Canada. However, carrying a valid passport is still recommended, in the rare event that a flight is diverted to an airport without NEXUS support.

<span class="mw-page-title-main">Visa policy of the Schengen Area</span> Policy on permits required to enter the Schengen Area

The visa policy of the Schengen Area is a component within the wider area of freedom, security and justice policy of the European Union. It applies to the Schengen Area and to other EU member states except Ireland. The visa policy allows nationals of certain countries to enter the Schengen Area via air, land or sea without a visa for stays of up to 90 days within a 180-day period. Nationals of certain other countries are required to have a visa either upon arrival or in transit.

<span class="mw-page-title-main">SENTRI</span>

The Secure Electronic Network for Travelers Rapid Inspection (SENTRI) provides expedited U.S. Customs and Border Protection (CBP) processing, at the U.S.-Mexico border, of pre-approved travelers considered low-risk. Voluntarily applicants must undergo a thorough background check against criminal, customs, immigration, law enforcement, and terrorist databases; a 10-fingerprint law enforcement check; and a personal interview with a CBP Officer. The total enrollment fee is $122.50, and SENTRI status is valid for 5 years.

<span class="mw-page-title-main">Schengen Area</span> Area of 27 European states without mutual border controls

The Schengen Area is an area comprising 27 European countries that have officially abolished many passport and many other types of border control at their mutual borders. Being an element within the wider area of freedom, security and justice policy of the European Union (EU), it mostly functions as a single jurisdiction under a common visa policy for international travel purposes. The area is named after the 1985 Schengen Agreement and the 1990 Schengen Convention, both signed in Schengen, Luxembourg.

<span class="mw-page-title-main">Arrival card</span>

An arrival card, also known as an incoming passenger card, landing card or disembarkation card, is a legal document used by immigration authorities of many countries to obtain information about incoming passenger not provided by the passenger's passport and to provide a record of a person's entry into the country. The card may also provide information on health and character requirements for non-citizens entering the country. Some countries require an arrival card for each incoming passenger, while others require one card per family unit, and some only require an arrival card for non-citizens only.

The gallery of passport stamps by country or territory contains an alphabetical list of sovereign states or dependent territories with images of their passport stamps including visas. All Schengen countries, Bulgaria, Cyprus and Romania use the same format for their stamps, and stamps are not issued while traveling from one Schengen country to another.

<span class="mw-page-title-main">Juxtaposed controls</span>

Juxtaposed controls are a reciprocal arrangement between Belgium, France, the Netherlands and the United Kingdom whereby border controls on certain cross-Channel routes take place before boarding the train or ferry, rather than upon arrival after disembarkation. With the exception of the Eurotunnel Shuttle route, customs checks remain unaffected by juxtaposed immigration controls and continue to take place upon arrival after disembarkation. Belgium, France and the Netherlands are all member states of the European Union and part of the border-free Schengen Area. The United Kingdom, on the other hand, has never participated in the Schengen Area, even when it was a member state of the European Union. As a result, juxtaposed controls aim to increase the convenience and efficiency of border checks when travelling by train or ferry between the Schengen Area and the UK by removing the need for immigration checks on arrival and by streamlining checks on departure. At the same time, juxtaposed controls are intended to detect and prevent illegal immigration. In 2016, there were over 56,000 instances when people were refused entry to the UK at the juxtaposed controls.

<span class="mw-page-title-main">Automated border control system</span> Type of automated self-service barrier

Automated border control systems (ABC) or eGates are automated self-service barriers which use data stored in a chip in biometric passports along with a photo or fingerprint taken at the time of entering the eGates to verify the passport holder's identity. Travellers undergo biometric verification using facial or iris recognition, fingerprints, or a combination of modalities. After the identification process is complete and the passport holder's identity is verified, a physical barrier such as a gate or turnstile opens to permit passage. If the passport holder's identification is not verified or if the system malfunctions, then the gate or turnstile does not open and an immigration officer will meet the person. E-gates came about in the mid-2000s as an automated method of reading the then-newly ICAO mandated e-passports.

<span class="mw-page-title-main">Travel during the COVID-19 pandemic</span> Restrictions by countries intended to stop spread of disease

During the COVID-19 pandemic, many countries and regions imposed quarantines, entry bans, or other travel restrictions for citizens of or recent travelers to the most affected areas. Some countries and regions imposed global restrictions that apply to all foreign countries and territories, or prevent their own citizens from travelling overseas.

Deportations of Iranian students at US airports were a series of events that began in 2019 and continued until 2020, when the COVID-19 pandemic began. In this series of events, Iranian students, despite having a valid student visa, were detained at US airports and later deported. These expulsions have been on the rise since 2019.

Controls imposed on internal borders within a single state or territory include measures taken by governments to monitor and regulate the movement of people, animals, and goods across land, air, and maritime borders through border controls.
