12 April – British ship George III , transporting male convicts from Woolwich to Hobart sinks in D'Entrecasteaux Channel with the loss of around 134 (128 convicts) of the 294 people on board.
13 May – British barque Neva , transporting female convicts from Cork, Ireland, is wrecked in the Bass Strait with the loss of 224 people and only 15 survivors.^[1]
6 June – Batman's Treaty is created between John Batman and Wurundjeri elders to secure the land around Port Phillip Bay for the establishment of Melbourne. The treaty was later declared void by the Governor of New South Wales, Richard Bourke.
6 August – Proclamation of Governor Bourke, a document which formally declared that the British Crown, relying on the doctrine of terra nullius , owned the whole of the continent of Australia.
13 September - John Bede Polding, the first Catholic bishop in Australia, arrives in Sydney.
10 October – The Proclamation of Governor Bourke is approved by the Colonial Office. Bourke's proclamation implemented the doctrine of terra nullius by proclaiming that Indigenous Australians could not sell or assign land, nor could an individual person acquire it, other than through distribution by the Crown.
29 December – Mary Gilbert gives birth to her son, James Port Phillip Gilbert, the first European child born in the Port Phillip settlement of Melbourne.

General Sir Richard Bourke, KCB, was an Irish soldier, who served in the British Army and was Governor of New South Wales from 1831 to 1837. As a lifelong Whig (Liberal), he encouraged the emancipation of convicts and helped bring forward the ending of penal transportation to Australia. In this, he faced strong opposition from the landlord establishment and its press. He approved a new settlement on the Yarra River, and named it Melbourne, in honour of the incumbent British prime minister, Lord Melbourne.

The history of Australia from 1788 to 1850 covers the early British colonial period of Australia's history. This started with the arrival in 1788 of the First Fleet of British ships at Port Jackson on the lands of the Eora, and the establishment of the penal colony of New South Wales as part of the British Empire. The Port Phillip Association was formally formed in June 1835 to settle land in what would become Melbourne, which the association believed had been acquired by John Batman for the association from Wurundjeri elders after he had obtained their marks to a document, which came to be known as Batman's Treaty.

The Constitutional history of Australia is the history of Australia's foundational legal principles. Australia's legal origins as a nation state began in the colonial era, with its legal system reliant initially upon a legal fiction of terra nullius to impose British law upon the colony of New South Wales. As the colonies expanded, Australia gradually began to achieve de facto independence. Over the years as a result the foundations of the Australian legal system gradually began to shift. This culminated in the Australia Act, an act formally ending legal ties with the UK.

Melbourne Day is an annual celebration to mark the founding of Melbourne in Victoria, Australia, on 30 August 1835.

The Proclamation of Governor Bourke was a document written by Sir Richard Bourke, KCB, the Governor of New South Wales, and issued by the British Colonial Office on 26 August 1835.
