This is a breakdown of the results of the 2009 German federal election. The following tables display detailed results in each of the sixteen states and all 299 single-member constituencies.

Electoral system

According to Article 38 of the Basic Law for the Federal Republic of Germany, members of the Bundestag shall be elected in general, direct, free, equal and secret elections; everyone over the age of eighteen is entitled to vote. [1]

In 2008, some modifications to the electoral system were required under an order of the Federal Constitutional Court. The court had found a provision in the Federal Election Law by which it was possible for a party to experience a negative vote weight, thus losing seats due to more votes, violated the constitutional guarantee of the electoral system being equal and direct. The court allowed three years for these changes, so the 2009 federal election was not affected. [2]

The Bundestag is elected using mixed-member proportional representation. Each voter has two votes, a first vote for the election of a constituency candidate (by method of first-past-the-post [3] ), and a second vote for the election of a state list. [4] The Sainte-Laguë/Schepers method is used to convert the votes into seats, [5] in a two-stage process with each stage involving two calculations. First, the number of seats to be allocated to each state is calculated, based on the proportion of the German population living there. Then the seats in each state are allocated to the party lists in that state, based on the proportion of second votes each party received. [6]

In the distribution of seats among state lists, only parties that have obtained at least five percent of the valid second votes cast in the electoral area or have won a seat in at least three constituencies are taken into consideration. [6]

Additional "overhang seats" are created to ensure that no party receives fewer than its guaranteed minimum number of seats. This has the side-effect of inflating the size of the Bundestag if a party wins more direct mandates than its vote share entitles it to. Once the number of seats which each party is entitled to receive across the country has been determined, the seats are allocated to the parties' individual state lists. [6]

<span class="mw-page-title-main">2013 German federal election</span>

Federal elections were held on 22 September to elect the members of the 18th Bundestag of Germany. At stake were all 598 seats to the Bundestag, plus 33 overhang seats determined thereafter. The Christian Democratic Union of Germany/Christian Social Union of Bavaria (CDU/CSU) of incumbent chancellor Angela Merkel won their best result since 1990 with nearly 42% of the vote and nearly 50% of the seats, just five short for an overall majority. The Free Democratic Party (FDP) failed to meet the 5% vote electoral threshold in what was their worst showing ever in a federal election, denying them seats in the Bundestag for the first time in their history.

<span class="mw-page-title-main">2009 European Parliament election in Germany</span> Election of the delegation from Germany to the European Parliament in 2009

The German part of the 2009 European Parliament election was held on Sunday, 7 June. A total of 26 parties competed for the 99 seats reserved for Germany in the European Parliament. In the previous election of 2004, the six parties which were represented in the German national parliament (Bundestag) from 2005 to 2013, had entered the European Parliament by overcoming the 5% election threshold. The same parties entered the European Parliament this time. None of the other parties managed to gain more than 1.7%, but together the small parties exceeded 10% for the first time. At 43.3%, the voter turnout was just over the all-time low in the previous European election in Germany (43.0%).

The German federal election system regulates the election of the members of the national parliament, called the Bundestag. According to the principles governing the elections laws, set down in Art. 38 of the German Basic Law, elections are to be universal, direct, free, equal, and secret. Furthermore, the German Basic Law stipulates that Bundestag elections are to take place every four years and that one can vote, and be elected, upon reaching the age of 18. All other stipulations for the federal elections are regulated by the Federal Electoral Act. Elections always take place on a Sunday. Mail votes are possible upon application.

The state of defence is the constitutional state of emergency in Germany if the country is "under attack by armed force or imminently threatened with such an attack". Established by a constitutional amendment in 1968 during the Cold War, this state of emergency gives the Federal Government extraordinary powers in wartime. It is laid down in Title Xa of the German Constitution. As of present, Germany has never been in the state of defence.

<span class="mw-page-title-main">2025 German federal election</span> General election for the 21st German Bundestag

Federal elections in Germany will be held to elect the members of the 21st Bundestag. They are currently scheduled to be held on 28 September 2025. However, the elections are expected to be brought forward to 23 February due to the collapse of the governing traffic light coalition during the 2024 German government crisis. If held early, the 2025 election would be the fourth snap election in the history of post-war Germany after those in 1972, 1983 and 2005.

In Germany, the state list or state electoral proposal, is the list of candidates of a party for the election to the Bundestag, or the elections to those state parliaments with mixed-member proportional representation and for the European Parliament elections if a party decides on a state rather than a federal list. In contrast to the vote on the candidates of the constituencies, who are elected directly (Direktmandat), voters can usually only vote on the candidates on the state list as a whole by voting for a party with their second vote. Depending on the distribution of seats in parliament, the corresponding number of candidates in the order of the list of the respective party are considered elected.
