The Office of Rail and Road (ORR) is a non-ministerial government department responsible for the economic and safety regulation of Britain's railways, and the economic monitoring of National Highways.
ORR regulates Network Rail by setting its activities and funding requirements for each Control Period, ensuring train operators have fair access to the railway network, and enforcing compliance with its network licence. ORR also regulates High Speed 1, the Channel Tunnel, and also acts as the appeal body, controls the network statement and monitors the competitive situation of rail services in Northern Ireland. It is the competition authority for the railways and enforces consumer protection law in relation to the railways. [4]
From April 2015, ORR assumed responsibility for monitoring National Highways' management of the strategic road network – the motorways and main 'A' roads in England – and advising the Secretary of State for Transport on the levels of funding and performance requirements for each Road Period. [5]
ORR was established as the Office of Rail Regulation on 5 July 2004 by the Railways and Transport Safety Act 2003, replacing the Rail Regulator. It became the Office of Rail and Road on 1 April 2015 following ORR's appointment as Monitor for National Highways under the Infrastructure Act 2015. [6]
Network Rail – the owner and operator of most of the railway network in England, Scotland and Wales – operates under a network licence. ORR holds Network Rail to account through the network licence which includes conditions relating to its management of the railway network, information provision and safety obligations.
ORR is also responsible for setting Network Rail's outputs and funding requirement for each Control Period, including the access charges paid by train and freight operating companies to Network Rail for the use of its infrastructure. [7] ORR then holds Network Rail to account against the delivery, performance and service levels set out in its final determination.
ORR is concerned with the regulation of Network Rail as the monopoly owner of much of Britain's railway infrastructure. It does not play a direct role in regulating fares (responsibility for this lies with the Department for Transport).
ORR regulates the High Speed 1 line between St Pancras and the Channel Tunnel. This line is operated by HS1 Ltd, and is separate to the rest of the national railway network operated by Network Rail, but ORR regulates it in much the same way. This includes holding HS1 to account for its performance, service and value for money for passengers and the freight industry.
ORR regulates health and safety for the entire mainline rail network in Britain, as well as London Underground, light rail, trams and the heritage sector. ORR has a team of more than 100 rail health and safety inspectors and professionals who have powers of enforcement. Their remit is to ensure that the railway is safe, and is kept safe, at a reasonably practicable cost.
A primary role for ORR is to enforce consumer law and compliance with the conditions contained in Network Rail’s and train operators’ licences, to help ensure that all rail users get the service to which they are entitled.
National Highways operates, maintains and improves England's strategic road network, operating under a licence (managed by the Department for Transport). ORR monitors and enforces the performance and efficiency of National Highways against the outputs set out in the government's Road Investment Strategy and licence, and advises the Secretary of State for Transport on the funding levels and performance requirements for each Road Period. In carrying out its railway functions, ORR must discharge its statutory duties, which are its formal objectives. These are laid down in section 4 of the Railways Act 1993, and include the protection of the interests of users and the promotion of competition, efficiency and economy in the provision of railway services.
ORR’s duties as the Monitor for National Highways are set out in section 12 of the Infrastructure Act 2015. These require that ORR must exercise its functions in the way it considers most likely to promote the performance and efficiency of National Highways. ORR also has a role within The Railways (Access, Management and Licensing of Railway Undertakings) Regulations 2016.
Like other public authorities, ORR must comply with the rules of administrative law, and is amenable to judicial review, so it must act lawfully, rationally, proportionately and in accordance with the relevant rules of procedure. Although operationally independent of central government as a non-ministerial government department, it is still covered by legislation such as the Freedom of Information Act 2000.
All members of the ORR board are appointed by the Secretary of State for Transport for a fixed term of up to five years. The current ORR Chair is Declan Collier, appointed in January 2019. John Larkinson is Chief Executive Officer.
ORR employs approximately 350 people, with offices in London, Birmingham, Bristol, Glasgow, Manchester and York.
ORR is the main provider of railway industry statistics in Britain.
ORR publishes a range of statistics about railway performance, rail usage and safety – to support performance evaluation, analysis and decision-making for the railway industry. It produces usage statistics for each station.
The railway system in Great Britain is the oldest railway system in the world. The first locomotive-hauled public railway opened in 1825, which was followed by an era of rapid expansion. Most of the track is managed by Network Rail, which in 2017 had a network of 9,824 miles (15,811 km) of standard-gauge lines, of which 3,339 miles (5,374 km) were electrified. In addition, some cities have separate metro, light rail and tram systems, among them the historic London Underground and the Glasgow Subway. There are also many private railways, some of them narrow-gauge, which are primarily short lines for tourists. The main rail network is connected with that of continental Europe by the Channel Tunnel and High Speed 1, opened in 1994 and 2007 respectively.

High Speed 1 (HS1), legally the Channel Tunnel Rail Link (CTRL), is a 109.9-kilometre (68.3-mile) high-speed railway linking London with the Channel Tunnel.
Network Rail Limited is the owner and infrastructure manager of most of the railway network in Great Britain. Network Rail is a non-departmental public body of the Department for Transport with no shareholders, which reinvests its income in the railways.
There are effectively two separate mainline railway systems in the United Kingdom – the Great Britain system and the Northern Ireland system, which are regulated and operated separately, and are constituted under separate pieces of United Kingdom legislation.
The privatisation of British Rail was the process by which ownership and operation of the railways of Great Britain passed from government control into private hands. Begun in 1994, the process was largely completed by 1997. The deregulation of the industry was in part motivated by the enactment of EU Directive 91/440 in 1991, which aimed to create a more efficient railway network by creating greater competition.
National Highways (NH), formerly the Highways Agency and later formerly Highways England, is a government-owned company charged with operating, maintaining and improving motorways and major A roads in England. It also sets highways standards used by all four UK administrations, through the Design Manual for Roads and Bridges. Within England, it operates information services through the provision of on-road signage and its Traffic England website, provides traffic officers to deal with incidents on its network, and manages the delivery of improvement schemes to the network.

The Federal Railroad Administration (FRA) is an agency in the United States Department of Transportation (DOT). The agency was created by the Department of Transportation Act of 1966. The purpose of the FRA is to promulgate and enforce rail safety regulations, administer railroad assistance programs, conduct research and development in support of improved railroad safety and national rail transportation policy, provide for the rehabilitation of Northeast Corridor rail passenger service, and consolidate government support of rail transportation activities.
The Ministry of Transportation (MTO) is the provincial ministry of the Government of Ontario that is responsible for transport infrastructure and related law in Ontario, Canada. The ministry traces its roots back over a century to the 1890s, when the province began training Provincial Road Building Instructors. In 1916, the Department of Public Highways of Ontario (DPHO) was formed and tasked with establishing a network of provincial highways. The first was designated in 1918, and by the summer of 1925, sixteen highways were numbered. In the mid-1920s, a new Department of Northern Development (DND) was created to manage infrastructure improvements in northern Ontario; it merged with the Department of Highways of Ontario (DHO) on April 1, 1937. In 1971, the Department of Highways took on responsibility for Communications and in 1972 was reorganized as the Ministry of Transportation and Communications (MTC), which then became the Ministry of Transportation in 1987.
Transport in Melbourne, the state capital of Victoria, Australia, consists of several interlinking modes. Melbourne is a hub for intercity, intracity and regional travel. The Rail Regulator was a statutory office holder, created with effect from 1 December 1993 by section 1 of the Railways Act 1993, for the independent economic regulation of the British railway industry. The Rail Regulator was in charge of an executive agency called the Office of the Rail Regulator.
The railway network of Great Britain is operated with the aid of a number of documents, which have been sometimes termed "technical manuals", because they are more detailed than the pocket-timetables which the public encounters every day. The Rail Safety and Standards Board (RSSB) is a British independent company limited by guarantee. Interested parties include various rail industry organisations, including Network Rail, train operating companies (TOCs), and rolling stock companies (ROSCOs). The RSSB operates as a not-for-profit entity, its primary purpose being to bring about improved health and safety performance throughout Britain's railway network.
The Salter Report was named after Arthur Salter, who chaired an influential conference of road and rail experts in 1932 which reported in 1933. The report directed British government policy for transport funding for decades to follow.
The Ministry of Road Transport and Highways (MoRTH) is a ministry of the Government of India, that is the apex body for formulation and administration of the rules, regulations and laws relating to road transport, transport research and in also to increase the mobility and efficiency of the road transport system in India. Through its officers of Central Engineering Services (Roads) cadre it is responsible for the development of National Highways of the country.
The Rail Safety Act 2006 is a law enacted by the Parliament of the State of Victoria, Australia, and is the prime statute regulating the safety of rail operations in Victoria. The Act was developed as part of the Transport Legislation Review conducted by the Department of Transport between 2004 and 2010 and is aimed at preventing deaths and injuries arising from rail operations.
The Director of Public Transport was the head of the Public Transport Division (PTD) of the Victorian Department of Transport. PTD was the government agency responsible for promoting, providing, coordinating and regulating public transport in the state of Victoria, Australia between August 1999 and June 2013. The Director of Public Transport was created as a statutory office supported by staff of the Department of Transport.
The Federal Office of Transport FOT is a federal authority of the Swiss Confederation. It deals with public transport in Switzerland, i.e. railways, cableways, trolleybuses, buses and ships. It is also responsible for various aspects of freight transport. It implements the policies of the government, parliament and the Swiss electorate (sovereign) in these areas. The FOT reports to the Federal Department of the Environment, Transport, Energy and Communications (DETEC). The office employs 350 people in five divisions: Business Administration and Organisation, Infrastructure, Finance, Safety and Policy. Peter Füglistaler, who was previously a member of the Executive Board of SBB Infrastructure, has been Director since June 2010[1].
Transportation in the United States is governed by laws and regulations of the federal government. The Department of Transportation is responsible for carrying out federal transportation policy, and the Department of Homeland Security is responsible for security in transportation.
