Parties to the Chemical Weapons Convention encompasses the states that have ratified or acceded to the Chemical Weapons Convention, a multilateral treaty outlawing the production, stockpiling, and use of chemical weapons. In addition, these states are members of the Organisation for the Prohibition of Chemical Weapons (OPCW).

Contents

On January 13, 1993, the Convention was opened for signature. [1] Fiji became the first state to ratify the Convention on January 20, 1993. [1] Pursuant to article 21 of the Convention, it entered into force on April 29, 1997, after it had been ratified by 65 states. [1] The Convention was closed for signature on the preceding day, and states that did not sign the Convention can now only accede to it. Pursuant to article 21 of the Convention, for states that ratify or accede to the Convention after this date, the Convention enters into force 30 days after their deposit of the instrument of ratification or accession.

A total of 197 states may become parties to the Chemical Weapons Convention, including 193 United Nations member states, the Cook Islands, Niue, Palestine, and Vatican City. As of August 2022, 193 states have ratified or acceded to the Convention (most recently Palestine on 17 May 2018) and another state (Israel) has signed but not ratified the Convention. [1] Only Egypt, North Korea, and South Sudan have neither signed nor acceded to the Convention. All four states which are not parties are suspected of possessing chemical weapons.

Of the four non-parties, South Sudan stated in December 2017 that it "has all but concluded the process of joining the Organisation for the Prohibition of Chemical Weapons". [2] Ahmet Üzümcü, the Director-General of the OPCW, has stated that Egypt, Israel, and North Korea had "regional reasons" for not joining. [3] [4] Egypt has promised to ratify the Convention if Israel, the only state in the Middle East that is believed to possess nuclear weapons, ratifies the Treaty on the Non-Proliferation of Nuclear Weapons. [5] [6] [7] Israel, meanwhile, has stated that it will ratify the Convention if all other non-parties in the region (of which only Egypt remains) do so as well. [5] [8] In addition, Israel has been reluctant to ratify due to an unwillingness to grant OPCW inspectors access to its military bases. [9] North Korea is thought to be unlikely to become a party for the foreseeable future. [10]

The Organisation for the Prohibition of Chemical Weapons (OPCW) is an intergovernmental organisation and the implementing body for the Chemical Weapons Convention (CWC), which entered into force on 29 April 1997. The OPCW, with its 193 member states, has its seat in The Hague, Netherlands; it oversees the global endeavour for the permanent and verifiable elimination of chemical weapons.

The Protocol for the Prohibition of the Use in War of Asphyxiating, Poisonous or other Gases, and of Bacteriological Methods of Warfare, usually called the Geneva Protocol, is a treaty prohibiting the use of chemical and biological weapons in international armed conflicts. It was signed at Geneva on 17 June 1925 and entered into force on 8 February 1928. It was registered in League of Nations Treaty Series on 7 September 1929. The Geneva Protocol is a protocol to the Convention for the Supervision of the International Trade in Arms and Ammunition and in Implements of War signed on the same date, and followed the Hague Conventions of 1899 and 1907.

<span class="mw-page-title-main">Chemical Weapons Convention</span> Multilateral treaty prohibiting the production, stockpiling, and use of chemical weapons

The Chemical Weapons Convention (CWC), officially the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, is an arms control treaty administered by the Organisation for the Prohibition of Chemical Weapons (OPCW), an intergovernmental organization based in The Hague, The Netherlands. The treaty entered into force on 29 April 1997. It prohibits the use of chemical weapons, and also prohibits large-scale development, production, stockpiling, or transfer of chemical weapons or their precursors, except for very limited purposes. The main obligation of member states under the convention is to effect this prohibition, as well as the destruction of all current chemical weapons. All destruction activities must take place under OPCW verification.

<span class="mw-page-title-main">Chemical weapon proliferation</span> Prevalence and spread of chemical weapons

Many nations continue to research and/or stockpile chemical weapon agents despite numerous efforts to reduce or eliminate them. Most states have joined the Chemical Weapons Convention (CWC), which required the destruction of all chemical weapons by 2012. Twelve nations have declared chemical weapons production facilities and six nations have declared stockpiles of chemical weapons. All of the declared production facilities have been destroyed or converted to civilian use after the treaty went into force.

<span class="mw-page-title-main">Algeria and weapons of mass destruction</span>

In 1991, the government of the United States said it had unearthed details of the alleged construction of a nuclear reactor in Algeria. The Washington Times accused the country of developing nuclear weapons with the help of the Chinese government. The Algerian government admitted it was building a reactor, but denied any secrecy or military purpose. Surveillance from U.S. satellites also suggested that the reactor would not be used for military purposes. China had secretly made an agreement in 1983 to assist Algeria in developing a nuclear reactor.

<span class="mw-page-title-main">States parties to the Rome Statute</span> States that have become party to the Rome Statute of the International Criminal Court

The states parties to the Rome Statute of the International Criminal Court are those sovereign states that have ratified, or have otherwise become party to, the Rome Statute. The Rome Statute is the treaty that established the International Criminal Court, an international court that has jurisdiction over certain international crimes, including genocide, crimes against humanity, and war crimes that are committed by nationals of states parties or within the territory of states parties. States parties are legally obligated to co-operate with the Court when it requires, such as in arresting and transferring indicted persons or providing access to evidence and witnesses. States parties are entitled to participate and vote in proceedings of the Assembly of States Parties, which is the Court's governing body. Such proceedings include the election of such officials as judges and the Prosecutor, the approval of the Court's budget, and the adoption of amendments to the Rome Statute.

<span class="mw-page-title-main">2013 Nobel Peace Prize</span> Award

The 2013 Nobel Peace Prize was awarded to the Organisation for the Prohibition of Chemical Weapons for their "extensive work to eliminate chemical weapons". The award citation indicated the organization was awarded the prize, because they "have defined the use of chemical weapons as taboo under international law. Recent events in Syria, where chemical weapons have again been put to use, have underlined the need to enhance the efforts to do away with such weapons." The committee criticized Russia and the United States for not meeting the extended deadline for destruction of its chemical weapons, and noted that certain countries "are still not members". The OPCW was the 22nd organization to be awarded the prize.

Syria's chemical weapons program began in the 1970s with weapons and training from Egypt and the Soviet Union, with production of chemical weapons in Syria beginning in the mid-1980s. For some time, Syria was believed to have the world's third-largest stockpile of chemical weapons, after the United States and Russia. Prior to September 2013 Syria had not publicly admitted to possessing chemical weapons, although Western intelligence services believed it to hold one of the world's largest stockpiles. In September 2013, French intelligence put the Syrian stockpile at 1,000 tonnes, including Yperite, VX and "several hundred tonnes of sarin". At the time, Syria was one of a handful of states which had not ratified the Chemical Weapons Convention. In September 2013, Syria joined the CWC, and agreed to the destruction of its weapons, to be supervised by the Organisation for the Prohibition of Chemical Weapons (OPCW), as required by the convention. A joint OPCW-United Nations mission was established to oversee the destruction process. Syria joined OPCW after international condemnation of the August 2013 Ghouta chemical attack, for which Western states held the Syrian government responsible and agreed to the prompt destruction of its chemical weapons, resulting in U.S. Secretary of State John Kerry declaring on 20 July 2014: "we struck a deal where we got 100 percent of the chemical weapons out." The destruction of Syria's chemical weapons that the Assad government had declared was completed by August 2014, yet further disclosures, incomplete documentation, and allegations of withholding part of Syria's chemical weapons stockpile since mean that serious concerns regarding chemical weapons and related sites in Syria remain. On 5 April 2017, the government of Syria allegedly unleashed a chemical attack that killed 70 civilians. A suspected chemical attack on Douma on 9 April 2018 that killed at least 49 civilians has been blamed on the Syrian Government.

<span class="mw-page-title-main">Day of Remembrance for All Victims of Chemical Warfare</span>

The Day of Remembrance for All Victims of Chemical Warfare is an annual event held November 30 as a "tribute to the victims of chemical warfare, as well as to reaffirm the commitment of the Organisation for the Prohibition of Chemical Weapons (OPCW) to the elimination of the threat of chemical weapons, thereby promoting the goals of peace, security, and multilateralism." It is officially recognised by the United Nations (UN) and has been celebrated since 2005. On the 2013 observance day, the UN Secretary-General Ban Ki-moon gave a speech where he stated:

On this Remembrance Day, I urge the international community to intensify efforts to rid the world of chemical weapons, along with all other weapons of mass destruction. Let us work together to bring all States under the Convention and promote its full implementation. This is how we can best honour past victims and liberate future generations from the threat of chemical weapons.
