Cultural exception

Cultural exception (French : l'exception culturelle) is a political concept introduced by France in General Agreement on Tariffs and Trade (GATT) negotiations in 1993 [1] to treat culture differently from other commercial products. In other words, its purpose is to consider cultural goods and services as exceptions in international treaties and agreements especially with the World Trade Organization (WTO). Its goals are to point out that States are sovereign as far as limitation of culture free trade is concerned in order to protect and promote their artists and other elements of their culture. Concretely, it can be seen through protectionist measures limiting the diffusion of foreign artistic work (quotas) or through subsidies distributed according to the country's cultural policy.

GATT negotiations (1993)

In 1992, some countries had voiced their concerns during the final negotiations of the Uruguay Round that implementation of the GATT principles on cultural goods and services "would undermine their cultural specificity (and unique status), in favour of their commercial aspects". [2]

The purpose of Cultural exception is to treat cultural goods and services differently from other traded goods and services because of the intrinsic differences of such goods and services. Many countries defended the fact that cultural goods and services "encompass values, identity and meanings that go beyond their strictly commercial value". [3] It notably allowed France to maintain quotas and subsidies to protect its cultural market from other nation's cultural products, most notably American, on television and radio. South Korean policy in favor of its movie industry is another example of how cultural exception is used to protect the audiovisual market. [4]

First the debate concerned mainly audiovisual products. Secondly, in the WTO liberalization process, every country decides which sectors it will deregulate. Audiovisual services is one of the sectors where the number of WTO members with commitments is the lowest (30, as of 31 January 2009) [5] (Source: WTO)

1994 NAFTA

In 1994, Canada included a cultural exemption clause in the North American Free Trade Agreement. [6]

MAI

Draft agreement negotiated between members of the Organisation for Economic Co-operation and Development (OECD) in 1995–1998, The Multilateral Agreement on Investment or MAI's ostensible purpose was to develop multilateral rules that would ensure international investment was governed in a more systematic and uniform way between states. After an intense global campaign was waged against the MAI by the treaty's critics, the host nation France announced in October 1998 that it would not support the agreement, effectively preventing its adoption due to the OECD's consensus procedures. The French government had identified respect for cultural differences as a requirement for French support for the agreement. [6] [7]

The French Cultural Exception

France has been especially notable in pursuing the policy of cultural exception and its stance has sometimes attracted criticism. It was pursued by André Malraux in the post-second world war period when he was French minister of culture. In each branch of culture there is an automatic subsidy system for creative works. One example of these measures is the National Center of Cinematography and the moving image, which taxes cinema ticket sales and uses those funds to help the production or distribution of French cinema. Another example of protectionist measures is the audiovisual law (Loi sur l'audiovisuel) which specified for instance that "radio has to broadcast 40% French songs and, within this quota, 20% new talents." [8]

The effects of this policy in France is suggested by the fact that between 2005 and 2011, between 45% and 55% of its film products were American imports, compared to 60 to 90% American imports in other European film markets. [9] [10] [11]

Cultural diversity at UNESCO

Cultural exception has been gradually replaced by the more consensual concept of cultural diversity [12] as shows the adoption in October 2005, of UNESCO's Convention on the Protection and Promotion of the Diversity of Cultural Expressions (which followed the Universal Declaration on Cultural Diversity). Sponsored by France and Canada, the convention was passed 148-2, with four nations abstaining from voting. The United States and Israel voted against the proposal.

The UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions is a legally binding international agreement that supports Member-States' wills to assert their right in applying cultural policies and measures that exclude cultural goods and services from international trade agreements. [13]

The United States claims that cultural exception is a form of protectionism that harms global trade and that the UNESCO Convention deals with such protectionism rather than cultural diversity. In addition, it claims that the UNESCO Convention allows for oppressive governments to suppress minority cultural voices. The film industry and other cultural industries in the United States are also against the concept of cultural exception, as it harms their export market, and have lobbied the United States to take its current position against cultural exception.[ citation needed ]

<span class="mw-page-title-main">Cultural diversity</span> Quality of diverse or different cultures

Cultural diversity is the quality of diverse or different cultures, as opposed to monoculture. It has a variety of meanings in different contexts, sometimes applying to cultural artefacts like music recordings or art works in museums, and sometimes applying to the variety of human cultures or traditions in a specific region, or in the world as a whole. It can also refer to the inclusion of different cultural perspectives in an organization or society.

Artistic freedom can be defined as "the freedom to imagine, create and distribute diverse cultural expressions free of governmental censorship, political interference or the pressures of non-state actors." Generally, artistic freedom describes the extent of independence artists obtain to create art freely. Moreover, artistic freedom concerns "the rights of citizens to access artistic expressions and take part in cultural life—and thus [represents] one of the key issues for democracy." The extent of freedom indispensable to create art freely differs regarding the existence or nonexistence of national instruments established to protect, to promote, to control or to censor artists and their creative expressions. This is why universal, regional and national legal provisions have been installed to guarantee the right to freedom of expression in general and of artistic expression in particular. In 2013, Ms Farida Shaheed, United Nations special rapporteur to the Human Rights Council, presented her "Report in the field of cultural rights: The right to freedom of expression and creativity" providing a comprehensive study of the status quo of, and specifically the limitations and challenges to, artistic freedom worldwide. In this study, artistic freedom "was put forward as a basic human right that went beyond the 'right to create' or the 'right to participate in cultural life'." It stresses the range of fundamental freedoms indispensable for artistic expression and creativity, e.g. the freedoms of movement and association. "The State of Artistic Freedom" is an integral report published by arts censorship monitor Freemuse on an annual basis.

The Proclamation of Masterpieces of the Oral and Intangible Heritage of Humanity was made by the Director-General of UNESCO starting in 2001 to raise awareness of intangible cultural heritage and encourage local communities to protect them and the local people who sustain these forms of cultural expressions. Several manifestations of intangible heritage around the world were awarded the title of Masterpieces to recognize the value of the non-material component of culture, as well as entail the commitment of states to promote and safeguard the Masterpieces. Further proclamations occurred biennially. In 2008, the 90 previously proclaimed Masterpieces were incorporated into the new Representative List of the Intangible Cultural Heritage of Humanity as its first entries.

<span class="mw-page-title-main">Canadian cultural protectionism</span>

Cultural protectionism in Canada has, since the mid-20th century, taken the form of conscious, interventionist attempts on the part of various governments of Canada to promote Canadian cultural production and limit the effect of foreign culture on the domestic audience. Sharing a large border and a common language with the United States, Canadian politicians have perceived the need to preserve and support a culture separate from US-based North American culture in the globalized media arena. Canada's efforts to maintain its cultural differences from the US and Mexico have been balanced by countermeasures in trade arrangements, including the General Agreement on Tariffs and Trade (GATT) and the North American Free Trade Agreement (NAFTA).

<span class="mw-page-title-main">Convention on the Protection and Promotion of the Diversity of Cultural Expressions</span> UNESCO-related treaty

The Convention on the Protection and Promotion of the Diversity of Cultural Expressions is an international treaty adopted in October 2005 in Paris during the 33rd session of the General Conference of the United Nations Educational, Scientific and Cultural Organization (UNESCO). In response to the fears that globalization would lead to an increasingly uniform global culture, it allows states to protect cultural diversity by promoting and defending their own cultural industries. It also establishes international co-operation to help protect the cultural industries of developing countries, including the creation of the International Fund for Cultural Diversity. It reaffirms many of the principles of the 2001 UNESCO Universal Declaration on Cultural Diversity but, unlike that declaration, it is legally binding and requires legal ratification by member states. The convention is the first international treaty to give cultural goods a special status, having cultural as well as economic value.

Traditional knowledge (TK), indigenous knowledge (IK) and local knowledge generally refer to knowledge systems embedded in the cultural traditions of regional, indigenous, or local communities. According to the World Intellectual Property Organization (WIPO) and the United Nations (UN), traditional knowledge and traditional cultural expressions (TCE) are both types of indigenous knowledge.

Iran is a member of the WIPO since 2001 and has acceded to several WIPO intellectual property treaties. Iran joined the Convention for the Protection of Industrial Property in 1959. In December 2003 Iran became a party to the Madrid Agreement and the Madrid Protocol for the International Registration of Marks. In 2005 Iran joined the Lisbon Agreement for the Protection of Appellations of Origin and their International Registration, which ensures the protection of geographical names associated with products. As at February 2008 Iran had yet to accede to The Hague Agreement for the Protection of Industrial Designs.

The Universal Declaration on Cultural Diversity is a declaration adopted unanimously by the General Conference of the United Nations Educational, Scientific and Cultural Organization (UNESCO) at its thirty-first session on 2 November 2001. It calls on nations and institutions to work together for the preservation of culture in all its forms, and for policies that help to share ideas across cultures and inspire new forms of creativity. It interprets "culture" in a broad sense and connects the preservation of culture to central issues of human rights. It defines a role for UNESCO as a space in which different institutions can develop ideas on cultural diversity, which has been a theme of many of UNESCO's activities in the years since. The primary audience of the declaration includes UNESCO's member states as well as international and non-governmental bodies, but other organisations and individuals have also been inspired by it.

<span class="mw-page-title-main">Direction régionale des affaires culturelles</span>

The Direction régionale des Affaires culturelles is a service of the French Minister of Culture in each region of France. Created by Minister of Culture André Malraux on February 23, 1963, it is in-charge of historical buildings, museums, cinema, theatre, and art.

The international trade of fine art is most precisely defined as the trade across nations of unique, non-reproducible works by an artist. The art trade contradicts typical international trade models since it is a culturally significant good. It is not treated by consumers the same way any other commodity would because of the aesthetic value that is unique to each piece. Despite existing as a finite physical piece, unique art is still considered intellectual property. This sparks the debate as to whether art exports should be restricted for nationalistic and cultural reasons, or liberalized for the sake of a healthier international market.

<span class="mw-page-title-main">Federal Office of Culture</span>

The Federal Office of Culture (FOC) is an administrative unit of the Federal Department of Home Affairs, based in Bern, Switzerland. The agency has two extensive areas of responsibility: promoting Swiss culture and preserving the country’s cultural heritage. In 2014, its total budget was close to 170 million francs. The FOC promotes culture in the fields of literature, theatre, dance, music, film, the visual arts and design. It helps preserve the cultural heritage by supporting the protection of monuments and archeological research, and it also maintains valuable collections, libraries, archives, and museums.

The cultural exemption is a concept that originated in international economic law and more specifically in bilateral and regional free trade agreements. The cultural exemption takes the form of a clause that has the effect of excluding from its scope cultural goods and services that would otherwise be covered by the commitments arising from the agreement in question. The purpose of this clause is to preserve the state's power of intervention with respect to these cultural goods and services, and therefore to protect its cultural sovereignty.

Cultural expressions are creative manifestations of the cultural identities of their authors. They are treated in the international legal system in terms of cultural rights, intellectual property law and international trade.
