Below is a list of the names of openly LGBT persons who have served on the highest court of a state or territory in the United States.

The first state with an openly LGBT justice was Oregon, where Rives Kistler was named to the bench in 2003. [1] The first U.S. territory with an openly LGBT justice was Guam, where Benjamin Cruz was appointed in 1997. [2] As of January 12,2024, there are 11 openly LGBT state supreme court justices, serving in 10 states.

Virginia Lynn Linder is an American judge from Oregon who served as the 99th justice of the Oregon Supreme Court from January 2007 until January 2016. She served on the Oregon Court of Appeals from 1997 until her election to the state's Supreme Court in the 2006, an electoral campaign in which she defeated former Labor Commissioner and Republican gubernatorial candidate Jack Roberts.

Mary Isabel Yu is an American lawyer who has served as an associate justice of the Washington Supreme Court since 2014. She served as a judge of the King County Superior Court from 2000 to 2014. She is the state's first openly gay, Asian American, and Latina justice. As of 2020, she is also the seventh woman serving and the eleventh woman ever to serve on Washington state's Supreme Court.

Lynn R. Nakamoto is an American judge who is a former justice of the Oregon Supreme Court. She was appointed to the court by Governor Kate Brown, and previously served on the Oregon Court of Appeals from 2011 to 2016.

Paul George Feinman was an American attorney who served as an associate judge of the New York Court of Appeals, New York's highest court, from June 2017 to March 2021.
