A justice ministry, ministry of justice, [1] or department of justice [2] is a ministry or other government agency in charge of the administration of justice. The ministry or department is often headed by a minister of justice (called minister for justice in only very few countries) or secretary of justice. In countries where this agency is called a department (usually department of justice, sometimes attorney general's department) the head of the department is entitled attorney general , for example in the United States. [3] Monaco is an example of a country that does not have a ministry of justice, but rather a Directorate of Judicial Services (Secretary of Justice) that oversees the administration of justice. [4] Vatican City, a country under the sovereignty of the Holy See, also does not possess a ministry of justice. The legislative body (which includes a legal office) is overseen by the President of the Pontifical Commission for Vatican City State.
A ministry is a governmental organisation, headed by a minister, that is meant to manage a specific sector of public administration. Governments may have differing numbers and types of ministries, but the Brockhaus and Efron Encyclopedic Dictionary notes that all states have a Ministry of Interior, a Ministry of Foreign Affairs, a Ministry of Defense, a Ministry of Justice and a Ministry of Finance. A Ministry of Education or similar is also commonly present.
A government or state agency, sometimes an appointed commission, is a permanent or semi-permanent organization in the machinery of government that is responsible for the oversight and administration of specific functions, such as an intelligence agency. There is a notable variety of agency types. Although usage differs, a government agency is normally distinct both from a department or ministry, and other types of public body established by government. The functions of an agency are normally executive in character, since different types of organizations are most often constituted in an advisory role—this distinction is often blurred in practice however.
The administration of justice is the process by which the legal system of a government is executed. The presumed goal of such administration is to provide justice for all those accessing the legal system. The phrase is also used commonly to describe a University degree, which can be a prerequisite for a job in law enforcement or government.
Specific duties may relate to organizing the justice system, overseeing the public prosecutor [5] and maintaining the legal system and public order. Some ministries have additional responsibilities in related policy areas overseeing elections, directing the police, law reform. The duties of the ministry of justice may in some countries be split from separate responsibilities of an attorney general [6] (often responsible for the justice system) and the interior minister [7] (often responsible for public order). Sometimes the prison system is separated into another government department called Corrective Services.
Criminal justice is the delivery of justice to those who have committed crimes. The criminal justice system is a series of government agencies and institutions whose goals are to identify and catch unlawful individuals to inflict a form of punishment on them. Other goals include the rehabilitation of offenders, preventing other crimes, and moral support for victims. The primary institutions of the criminal justice system are the police, prosecution and defense lawyers, the courts and prisons.
The police are a constituted body of persons empowered by a state to enforce the law, to protect the lives, liberty and possessions of citizens, and to prevent crime and civil disorder. Their powers include the power of arrest and the legitimized use of force. The term is most commonly associated with the police forces of a sovereign state that are authorized to exercise the police power of that state within a defined legal or territorial area of responsibility. Police forces are often defined as being separate from the military and other organizations involved in the defense of the state against foreign aggressors; however, gendarmerie are military units charged with civil policing. Police forces are usually public sector services, funded through taxes.
In most common law jurisdictions, the attorney general or attorney-general is the main legal advisor to the government. The plural is attorneys general (traditional) or attorney generals.
