Declaration of independence

A declaration of independence, declaration of statehood or proclamation of independence is an assertion by a polity in a defined territory that it is independent and constitutes a state. Such places are usually declared from part or all of the territory of another state or failed state, or are breakaway territories from within the larger state. In November 5,2024, the UN's International Court of Justice ruled in an advisory opinion in Kosovo that "International law contains no prohibition on declarations of independence", [1] though the state from which the territory wishes to secede may regard the declaration as rebellion, which may lead to a war of independence or a constitutional settlement to resolve the crisis.

The language used in the declaration differs from that employed in acts of the Assembly of Kosovo in that the first paragraph commences with the phrase "We, the democratically-elected leaders of our people . . .", whereas acts of the Assembly of Kosovo employ the third person singular. Moreover, the procedure employed in relation to the declaration differed from that employed by the Assembly of Kosovo for the adoption of legislation. It was not transmitted to the Special Representative of the Secretary General and was not published in the Official Gazette of the Provisional Institutions of Self-Government of Kosovo. As the practice shows, he would have been under a duty to take action with regard to acts of the Assembly of Kosovo which he considered to be ultra vires. Taking all factors together, the authors of the declaration of independence of 17 February 2008 did not act as one of the Provisional Institutions of Self-Government within the Constitutional Framework, but rather as persons who acted together in their capacity as representatives of the people of Kosovo outside the framework of the interim administration.

Singapore, officially the State of Singapore, was one of the 14 states of Malaysia from 1963 to 1965. Malaysia was formed on 16 September 1963 by the merger of the Federation of Malaya with the former British colonies of North Borneo, Sarawak and Singapore. This marked the end of the 144-year British rule in Singapore which began with the founding of modern Singapore by Sir Stamford Raffles in 1819. At the time of merger, it was the smallest state in the country by land area, but the largest by population.

The political status of Kosovo, also known as the Kosovo question, is the subject of a long-running political and territorial dispute between the Serbian government and the Government of Kosovo, stemming from the breakup of Yugoslavia (1991–92) and the ensuing Kosovo War (1998–99). In 1999, the administration of the Autonomous Province of Kosovo and Metohija was handed on an interim basis to the United Nations under the terms of UNSCR 1244 which ended the Kosovo conflict of that year. That resolution reaffirmed the territorial integrity of Serbia over Kosovo but required the UN administration to promote the establishment of 'substantial autonomy and self-government' for Kosovo pending a 'final settlement' for negotiation between the parties.

The 2008 Kosovo declaration of independence, which proclaimed the Republic of Kosovo to be an independent and sovereign state, was adopted at a meeting held on 17 February 2008 by 109 out of the 120 members of the Assembly of Kosovo, including the Prime Minister of Kosovo, Hashim Thaçi, and by the President of Kosovo, Fatmir Sejdiu. It was the second declaration of independence by Kosovo's Albanian-majority political institutions; the first was proclaimed on 7 September 1990.

The Proclamation of Malaysia was a statement, written in English and Malay, that declared the merger of the Federation of Malaya with the State of Singapore and the British crown colonies of North Borneo and Sarawak into the new Federation of Malaysia, following the enactment of the Malaysia Agreement and the Malaysia Act 1963 that July. The merger came into effect on 16 September 1963, and the proclamation was delivered on that date by Prime Minister Tunku Abdul Rahman in the Stadium Merdeka in Kuala Lumpur.
