The coastwise slave trade existed along the southern and eastern coastal areas of the United States in the antebellum years prior to 1861. Hundreds of vessels of various capacities domestically traded loads of slaves along waterways, generally from the Upper South which had a surplus of slaves to the Deep South where new cotton plantations created high demand for labor.

International tensions developed when ships were forced by weather or incident into ports in Bermuda and the British West Indies, as the British freed the slaves as part of the banned trade on the high seas, even before its abolition of slavery in its territories in 1834. There were several cases: Comet (1830), Encomium (1833), Enterprise (1835), Hermosa (1840), and, most notably, the Creole case of 1841, the result of a ship slave revolt that forced the vessel into Nassau, Bahamas. British officials freed the 128 slaves who chose to stay in the Bahamas.

Prior to 1807, the 1787 U.S. Constitution and the 1793 Fugitive Slave Act were the only national United States laws on slavery. Individual states had enacted laws authorizing and regulating slavery within their boundaries.

The multi-faceted 1807 Act Prohibiting Importation of Slaves abolished the "importation of slaves" from Africa, effective in 1808. The United States and Great Britain patrolled to create an international Blockade of Africa, trying to suppress the slave trade. In addition, US and British ships patrolled the Caribbean, where illegal slaves were generally brought for sale to the sugar plantations and smuggling into the U.S.

The 1807 Act also regulated the United States' "coastwise slave trade"; it protected shipping by domestic slave traders between markets along the other slave trading coasts. Attorneys argued that ships at sea were an extension of U.S. sovereignty, which permitted domestic slave trade among the states.

Conflict between U.S. and Britain in the Caribbean

Complications developed between the U.S. and Great Britain from their differing interpretations of the application of laws against the slave trade in the Caribbean colonies. When American merchant ships were forced by weather or incident into ports in Bermuda and the British West Indies, the British freed the slaves as part of the banned trade on the high seas, even before its abolition of slavery in its territories in 1834. As early as 1825, the Home Office in London had ruled that "any slave brought to the Bahamas from outside the British West Indies would be manumitted, which led to 300 slaves owned by U.S. nationals being freed." [1] In addition, slaves who escaped to the Bahamas from Florida became free.

Several cases occurred as anti-slavery agitation increased and abolition was passed: Comet (1830), Encomium (1833), Enterprise (1835), and Hermosa (1840) In each case, the British freed the slaves from the ships that had put into ports in Bermuda and the Bahamas, whether by weather or accident. [2]

The most notable case was the 1841 Creole, the result of a ship slave revolt that forced the vessel into Nassau, Bahamas. One of the slave leaders had heard of slaves being freed from the Hermosa there the previous year. [3]

Holding that the slaves were free persons illegally detained in slavery, British officials ultimately freed the 128 of 135 slaves from the Creole who chose to stay in the Bahamas. It has been termed the "most successful slave revolt in U.S. history". [4] The U.S. slaveholders feared this would encourage other slave ship revolts.

Cabotage

The act of sailing along a coast and using landmarks for guidance is called cabotage, from the French word caboter ("to coast," "go from cape to cape"). When slaves were the merchandise being transported by cabotage, the practice was called the coastwise slave trade.

The Blockade of Africa began in 1808 after the United Kingdom outlawed the Atlantic slave trade, making it illegal for British ships to transport slaves. The Royal Navy immediately established a presence off Africa to enforce the ban, called the West Africa Squadron. Although the ban initially applied only to British ships, Britain negotiated treaties with other countries to give the Royal Navy the right to intercept and search their ships for slaves.

The Creole case was a slave revolt aboard the American slave ship Creole in November 1841, when the brig was seized by the 128 slaves who were aboard the ship when it reached Nassau in the British colony of the Bahamas where slavery was abolished. The brig was transporting enslaved people as part of the coastwise slave trade in the American South. It has been described as the "most successful slave revolt in US history". Two died in the revolt, an enslaved person and a member of the crew.

The Slavery Abolition Act 1833 was an Act of the Parliament of the United Kingdom which provided for the gradual abolition of slavery in most parts of the British Empire. It was passed by Earl Grey's reforming administration and expanded the jurisdiction of the Slave Trade Act 1807 and made the purchase or ownership of slaves illegal within the British Empire, with the exception of "the Territories in the Possession of the East India Company", Ceylon, and Saint Helena. The Act came into force on 1 August 1834, and was repealed in 1998 as a part of wider rationalisation of English statute law; however, later anti-slavery legislation remains in force.

<span class="mw-page-title-main">Joseph Cinqué</span> West African captive and leader of La Amistad slave revolt in 1839

Sengbe Pieh, also known as Joseph Cinqué or Cinquez and sometimes referred to mononymously as Cinqué, was a West African man of the Mende people who led a revolt of many Africans on the Spanish slave ship La Amistad in July 1839. After the ship was taken into custody by the US Revenue-Marine, Cinqué and his fellow Africans were eventually tried for mutiny and killing officers on the ship, in a case known as United States v. The Amistad. This reached the U.S. Supreme Court, where Cinqué and his fellow Africans were found to have rightfully defended themselves from being enslaved through the illegal Atlantic slave trade and were released. The US government did not provide any aid to the acquitted Mende People. The United Missionary Society, a black group founded by James W.C. Pennington, helped raise money for the return of thirty-five of the survivors to Sierra Leone in 1842.

Madison Washington was an American enslaved man who led a slave rebellion in America on November 7, 1841, on board the brig Creole, which was transporting 134 other slaves from Virginia for sale in New Orleans, as part of the coastwise slave trade.

<i>La Amistad</i> Slave ship

La Amistad was a 19th-century two-masted schooner owned by a Spaniard living in Cuba. It became renowned in July 1839 for a slave revolt by Mende captives who had been captured and sold to European slave traders and illegally transported by a Portuguese ship from West Africa to Cuba, in violation of European treaties against the Atlantic slave trade. Spanish plantation owners Don José Ruiz and Don Pedro Montes bought 53 captives in Havana, Cuba, including four children, and were transporting them on the ship to their plantations near Puerto Príncipe. The revolt began after the schooner's cook jokingly told the slaves that they were to be "killed, salted, and cooked." Sengbe Pieh unshackled himself and the others on the third day and started the revolt. They took control of the ship, killing the captain and the cook. Three Africans were also killed in the melee.

<i>Mutiny on the Amistad</i>

Mutiny on the Amistad: The Saga of a Slave Revolt and Its Impact on American Abolition, Law, and Diplomacy (1987) is a history of a notable slave mutiny of 1839 and its aftermath, written by professor Howard Jones.

Afro-Bahamians are an ethnicity originating in The Bahamas of predominantly or partial native African descent. They are descendants of various African ethnic groups, many associated with the Bight of Biafra, Ghana, Songhai and Mali, the various Fula kingdoms, the Oyo Empire, and the Kingdom of Kongo. According to the 2010 census, 92.7% of The Bahamas' population identifies as mixed African descent.

The Enterprise was a United States merchant vessel active in the coastwise slave trade in the early 19th century along the Atlantic Coast. Bad weather forced it into Hamilton, Bermuda waters on February 11, 1835 while it carried 78 slaves in addition to other cargo. It became the centre of a minor international incident when the British authorities freed nearly all the slaves. Britain had abolished slavery in its Caribbean colonies effective 1834. At that time it advised "foreign nations that any slavers found in Bermuda [and the Bahamas] waters would be subject to arrest and seizure. Their cargoes were liable to forfeiture" without compensation.

Hermosa was an American slave ship whose 1840 grounding in the Bahamas led to a controversy between the United Kingdom and the United States over the 38 slaves who had been on board the ship and were freed by the British authorities.
