A popular initiative is a form of direct democracy by which a petition meeting certain hurdles can force a legal procedure on a proposition. The hurdles the petition has to meet vary between countries, typically signatures by a certain number of registered voters.
In the politics of the United States, the process of initiatives and referendums allow citizens of many U.S. states to place legislation on the ballot for a referendum or popular vote, either enacting new legislation, or voting down existing legislation. Citizens, or an organization, might start an initiative to gather a predetermined number of signatures to qualify the measure for the ballot. The measure is placed on the ballot for the referendum, or actual vote.
Prior to the Supreme Court's decision in Obergefell v. Hodges (2015), U.S. state constitutional amendments banning same-sex unions of several different types passed, banning legal recognition of same-sex unions in U.S. state constitutions, referred to by proponents as "defense of marriage amendments" or "marriage protection amendments." These state amendments are different from the proposed Federal Marriage Amendment, which would ban same-sex marriage in every U.S. state, and Section 2 of the Defense of Marriage Act, more commonly known as DOMA, which allowed the states not to recognize same-sex marriages from other states. The amendments define marriage as a union between one man and one woman and prevent civil unions or same-sex marriages from being legalized, though some of the amendments bar only the latter. The Obergefell decision in June 2015 invalidated these state constitutional amendments insofar as they prevented same-sex couples from marrying, even though the actual text of these amendments remain written into the state constitutions.
The Michigan Civil Rights Initiative (MCRI), or Proposal 2, was a ballot initiative in the U.S. state of Michigan that passed into Michigan Constitutional law by a 58% to 42% margin on November 7, 2006, according to results officially certified by the Michigan Secretary of State. By Michigan law, the Proposal became law on December 22, 2006. MCRI was a citizen initiative aimed at banning consideration of race, color, sex, or religion in admission to colleges, jobs, and other publicly funded institutions – effectively prohibiting some affirmative action by public institutions based on those factors. The Proposal's constitutionality was challenged in federal court, but its constitutionality was ultimately upheld by the Supreme Court of the United States.
Elections in Oregon are all held using a Vote by Mail (VBM) system. This means that all registered voters receive their ballots via postal delivery and can vote from their homes. A state Voters’ Pamphlet is mailed to every household in Oregon about three weeks before each statewide election. It includes information about each measure and candidate in the upcoming election.
The Michigan ballot proposals in 2012 included a referendum on a law passed by the Michigan Legislature and five proposed amendments to the Michigan Constitution. All six proposals were defeated.
Maine Question 1, formally An Act to Legalize Marijuana, is a citizen-initiated referendum question that qualified for the Maine November 8, 2016 statewide ballot. It was qualified for the ballot after a Maine Superior Court judge ordered that petitions rejected by the Maine Secretary of State be reconsidered. The proposal sought to legalize the recreational use of marijuana in Maine for those over the age of 21, and institute a 10 percent tax on its sale. As the Maine Legislature and Governor Paul LePage declined to enact the proposal as written, it appeared on the ballot along with elections for President of the United States, Maine's two U.S. House seats, the Legislature, other statewide ballot questions, and various local elections.
Michigan Proposal 18-2 was a ballot initiative approved by voters in Michigan as part of the 2018 United States elections. The proposal was created in preparation of the 2020 United States Census, to move control of redistricting from the state legislature to an independent commission. The commission consists of thirteen members selected randomly by the secretary of state: four affiliated with Democrats, four affiliated with Republicans, and five independents. Any Michigan voter can apply to be a commissioner, as long as they have not been, in the last six years, a politician or lobbyist. Proponents argued that Michigan's current districts are gerrymandered, giving an unfair advantage to one political party. Opponents argued that the process would give the secretary of state too much power over redistricting, and that the people on the commission would be unlikely to understand principles of redistricting. The proposal was approved with 61.28% of the vote.
The 2022 Michigan elections were held on Tuesday, November 8, 2022 throughout Michigan. The Democratic Party made historic gains, taking full control of state government for the first time since 1983. Democrats won control of the Michigan House of Representatives for the first time since 2008, and the Michigan Senate for the first time since 1984. Additionally, incumbent Democratic governor Gretchen Whitmer won reelection by a comfortable margin, with Democrats sweeping every statewide office. Furthermore, the Democrats maintained control of seven seats in the U.S. House of Representatives, while the Republican Party took a net loss of one seat. The elections in Michigan were widely characterized as a "blue wave".
2022 Michigan Proposal 1, the Legislative Term Limits and Financial Disclosure Amendment, is a legislatively-referred proposed constitutional amendment in the state of Michigan, which was voted on as part of the 2022 Michigan elections. The amendment modifies term limits in the Michigan state legislature and increase financial disclosure requirements for various elected officials. The amendment passed by a wide margin.
2022 Michigan Proposal 2, the Right to Voting Policies Amendment, and also known as Promote the Vote, was a citizen-initiated proposed constitutional amendment in the state of Michigan, which was voted on as part of the 2022 Michigan elections. The amendment changed voting procedures in the state with the goal of making it easier to vote.
2022 Michigan Proposal 3, the Right to Reproductive Freedom Initiative, also known as Reproductive Freedom for All, was a citizen-initiated proposed constitutional amendment in the state of Michigan, which was voted on as part of the 2022 Michigan elections. The amendment, which passed, codified reproductive rights, including access to abortion, in the Constitution of Michigan.
