A night-watchman state, also referred to as a minimal state or minarchy, whose proponents are known as minarchists, is a model of a state that is limited and minimal, whose functions depend on libertarian theory. Right-libertarians support it only as an enforcer of the non-aggression principle by providing citizens with the military, the police, and courts, thereby protecting them from aggression, theft, breach of contract, fraud, and enforcing property laws. In the United States, this form of government is mainly associated with libertarian and Objectivist political philosophy. In other countries, minarchism is also advocated by some non-anarchist libertarian socialists and other left-libertarians. [4] [5] A night-watchman state has also been popularized by Robert Nozick in Anarchy, State, and Utopia (1974). [6] The United Kingdom in the 19th century has been described by historian Charles Townshend as a standard-bearer for this form of government. [7]
As a term, night-watchman state (German: Nachtwächterstaat) was coined by German socialist Ferdinand Lassalle in an 1862 speech in Berlin wherein he criticized the bourgeois-liberal limited government state, comparing it to a nightwatchman. The phrase quickly caught on as a description of capitalist government, even as liberalism began to mean a more involved state, or a state with a larger sphere of responsibility. [8] Ludwig von Mises later opined that Lassalle tried to make limited government look ridiculous though it was no more ridiculous than governments that concerned themselves with "the preparation of sauerkraut, with the manufacture of trouser buttons, or with the publication of newspapers". [9]
Proponents of the night-watchman state are minarchists, a portmanteau of minimum and -archy. Arche ( /ˈɑːrki/ ; Ancient Greek : ἀρχή ) is a Greek word which came to mean "first place, power", "method of government", "empire, realm", "authorities" (in plural: ἀρχαί), or "command". [10] The term minarchist was coined by Samuel Edward Konkin III in 1980. [11]

Right-libertarian minarchists generally justify the state as a logical consequence of the non-aggression principle. [1] [2] [3] They argue that anarcho-capitalism is impractical because it is not sufficient to enforce the non-aggression principle, as the enforcement of laws under anarchy would be open to competition. [12] Another common objection to anarchism is that private defense and court firms would tend to represent the interests of those who pay them enough. [13]
Left-libertarian minarchists justify the state as a temporary measure on the grounds that social safety net benefits the working class. Some anarchists, such as Noam Chomsky, are in agreement with social democrats on the importance of welfare measures, but prefer using non-state methods. [14] Left-libertarians such as Peter Hain are decentralists who do not advocate abolishing the state, [4] but do wish to limit and devolve state power, [5] stipulating that any measures favoring the wealthy be prioritized for repeal before those which benefit the poor. [15]
Some minarchists argue that a state is inevitable because anarchy is futile. [16] Robert Nozick, who publicized the idea of a minimal state in Anarchy, State, and Utopia (1974), argued that a night-watchman state provides a framework that allows for any political system that respects fundamental individual rights and therefore morally justifies the existence of a state. Anarcho-capitalism is an anti-statist, libertarian political philosophy and economic theory that seeks to abolish centralized states in favor of stateless societies with systems of private property enforced by private agencies, based on concepts such as the non-aggression principle, free markets and self-ownership. In the absence of statute, anarcho-capitalists hold that society tends to contractually self-regulate and civilize through participation in the free market, which they describe as a voluntary society involving the voluntary exchange of goods and services. In a theoretical anarcho-capitalist society a system of private property would still exist, and would be enforced by private defense agencies and/or insurance companies that were selected by property owners, whose ownership rights or claims would be enforced by private defence agencies and/or insurance companies. These agencies or companies would operate competitively in a market and fulfill the roles of courts and the police. Some anarcho-capitalist authors have argued that voluntary slavery is compatible with anarcho-capitalist ideals.
Individualist anarchism is the branch of anarchism that emphasizes the individual and their will over external determinants such as groups, society, traditions, and ideological systems. Although usually contrasted with social anarchism, both individualist and social anarchism have influenced each other. Some anarcho-capitalists claim anarcho-capitalism is part of the individualist anarchist tradition, while others disagree and claim individualist anarchism is only part of the socialist movement and part of the libertarian socialist tradition. Economically, while European individualist anarchists are pluralists who advocate anarchism without adjectives and synthesis anarchism, ranging from anarcho-communist to mutualist economic types, most American individualist anarchists of the 19th century advocated mutualism, a libertarian socialist form of market socialism, or a free-market socialist form of classical economics. Individualist anarchists are opposed to property that violates the entitlement theory of justice, that is, gives privilege due to unjust acquisition or exchange, and thus is exploitative, seeking to "destroy the tyranny of capital,—that is, of property" by mutual credit.

It won the 1975 US National Book Award in category Philosophy and Religion, has been translated into 11 languages, and was named one of the "100 most influential books since the war" (1945–1995) by the UK Times Literary Supplement.
The nature of capitalism is criticized by left-wing anarchists, who reject hierarchy and advocate stateless societies based on non-hierarchical voluntary associations. Anarchism is generally defined as the libertarian philosophy which holds the state to be undesirable, unnecessary and harmful as well as opposing authoritarianism, illegitimate authority and hierarchical organization in the conduct of human relations. Ayn Rand's philosophy of Objectivism has been, and continues to be, a major influence on the right-libertarian movement, particularly libertarianism in the United States. Many right-libertarians justify their political views using aspects of Objectivism.
Samuel Edward Konkin III, also known as SEK3, was a Canadian-American left-libertarian philosopher and Austrian school economist. As the author of the publication New Libertarian Manifesto, he was a proponent of a political philosophy he named agorism.
Propertarianism, or proprietarianism, is a political philosophy that reduces all questions of law to the right to own property. On property rights, it advocates private property based on Lockean sticky property norms, where an owner keeps their property more or less until they consent to gift or sell it, rejecting the Lockean proviso. Propertarianism is often described by its advocates as either synonymous with capitalism or its logical conclusion.

Right-libertarianism, also known as libertarian capitalism, or right-wing libertarianism, is a libertarian political philosophy that supports capitalist property rights and defends market distribution of natural resources and private property. The term right-libertarianism is used to distinguish this class of views on the nature of property and capital from left-libertarianism, a variant of libertarianism that combines self-ownership with an anti-authoritarian approach to property and income. In contrast to socialist libertarianism, right-libertarianism supports free-market capitalism. Libertarian Party Radical Caucus is a caucus formed in 2006 within the United States Libertarian Party by Susan Hogarth and other party members who opposed removal of much of the material in the party platform during the 2006 national party convention. The caucus generally subscribes to an ideology of anarcho-capitalism. The caucus was active at the 2008 and 2010 Libertarian National Conventions. The radical caucus was revived and was extraordinarily active during the 2016 Libertarian National Convention.

Originally coined by French anarchist and libertarian communist Joseph Déjacque as an alternative synonymous to anarchism, American classical liberals appropriated the term in the 1950s for their philosophy which asserts that individuals have a right to acquire, keep and exchange their holdings and that the primary purpose of government is to protect these rights. Voluntary Socialism is a work of nonfiction by the American mutualist Francis Dashwood Tandy (1867–1913). First published in 1896, it was favorably cited by many individualist anarchists, including Clarence Lee Swartz, minarchist Robert Nozick and left-libertarian Roderick T. Long, who said "many of the standard moves in market anarchist theory today are already in evidence in Tandy".
