The Regulate Marijuana Like Alcohol initiative, listed on the ballot as Issue 2, [2] is a ballot initiative for legalization of cannabis in the U.S. state of Ohio that was passed by voters on November 7, 2023.
State law in Ohio allows citizens to bring initiatives before the state legislature, with signatures of at least 3 percent of the total vote cast for the office of governor at the last gubernatorial election. These must have been obtained from at least 44 of the 88 counties in Ohio. From each of these 44 counties, there must be signatures equal to at least 1.5 percent of the total vote cast for the office of governor in that county at the last gubernatorial election. [3] [4]
Upon meeting these requirements, a group can force the legislature to consider an initiative. Without action from the General Assembly or the Governor, by collecting more signature of a quantity again meeting the above-mentioned requirements, the group can force to send it to voters on the November ballot. In Ohio, a group called the Coalition to Regulate Marijuana Like Alcohol brought the initiative to the Ohio Secretary of State to be a 2022 ballot initiative. It was approved on August 30, 2021, for signature gathering. [5] [6] Over 200,000 signatures were submitted to the state at the end of 2021. [7] [8]
A lawsuit over filing deadlines resulted in the Ohio Secretary of State and the state legislature agreeing the initiative's signatures collected in 2021 and 2022 may be applied toward a 2023 ballot deadline. [9]
In July 2023, on an initial count of valid signatures, supporters came about 650 short. On August 3, more than ten times the remaining number required to validate the initiative for the November ballot were turned in to the secretary of state. [10] On August 16, 2023, the Secretary of State confirmed that the initiative would appear as a referendum ballot on November 7, 2023. [11]

Adults age 21 and up may purchase, possess and consume marijuana. Home grow of up to six plants per person or 12 plants per residence is allowed. The Division of Cannabis Control is established within the Ohio Department of Commerce to regulate commerce. Cannabis testing laboratories and supply chain are to be regulated. [8]
The initiative also specifies how tax revenues under the new law would be spent. Thirty-six percent (36%) would be designated for "social equity and jobs" programs, estimated to be as high as $150 million per year. Thirty-six percent (36%) would go to communities that have dispensaries. Twenty-five percent (25%) would go to education and addiction treatment programs, and 3% would be used for regulatory and administrative costs. [13]
The sponsor of the initiative, Campaign to Regulate Marijuana Like Alcohol, is an affiliate of Marijuana Policy Project. [14]
Ohio passed medical cannabis (along with decriminalized cannabis) in 2016 under Ohio House Bill 523. [15]
In early 2022, pro-cannabis advocates gathered signatures to send recreational legalization measure to the state legislature. In April, the Senate president publicly announced that he would not bring the measure up for a vote. Under Ohio law, advocates now have a second opportunity to gather more signatures, and if they gather enough, the measure will go on the ballot in November. “The recreational cannabis petition collected 136,000 verified signatures, enough to get considered by the General Assembly, but would require an additional 132,877 signatures to proceed to the ballot.” [15]
The largest organized opposition comes from the Center for Christian Virtue, which believes legalized cannabis will produce negative impacts on neighborhoods and society's drug addiction problems. The main proponent behind the ballot initiative is the Coalition to Regulate Marijuana Like Alcohol (CRMLA), which dismissed the Center for Christian Virtue's opposition as "Prohibition-style talking points from 20 years ago." [15]
In October 2023, Republican Senate President Matt Huffman warned that state legislators may repeal key provisions of Issue 2 if it passed. [16]

On November 8, the day after polling, top Republican leaders in Ohio indicated the possibility of overturning the measures approved by the voters in the ballot, along with those of Issue 1 on abortion. [41] Republicans who oppose the initiative are able to change the law and to repeal it due to holding majorities in both the Ohio House of Representatives and the Ohio Senate. [42] Ohio Senate leader Steve Huffman, a Republican, said that given the result, Ohio legislators "may consider amending the statute to clarify the questionable language regarding limits for THC and tax rates as well as other parts of the statute." [41] While Issue 2 mandates that marijuana tax revenue should be used to regulate marijuana, support substance abuse services, assist industry business owners and fund local governments where recreational business owners exist, Ohio House leader Jason Stephens, also a Republican, called for the Ohio "legislature to lead on how best to allocate tax revenues", and proposed "county jail construction and funding law enforcement training". [43]

The legal history of cannabis in the United States began with state-level prohibition in the early 20th century, with the first major federal limitations occurring in 1937. Starting with Oregon in 1973, individual states began to liberalize cannabis laws through decriminalization. In 1996, California became the first state to legalize medical cannabis, sparking a trend that spread to a majority of states by 2016. In 2012, Washington and Colorado became the first states to legalize cannabis for recreational use.
Oregon Ballot Measure 91 was a 2014 ballot measure in the U.S. state of Oregon. Its passage legalized the "recreational use of marijuana, based on regulation and taxation to be determined by the Oregon Liquor Control Commission".
Cannabis is strictly illegal in Wyoming. The state has some of the strictest cannabis laws in the United States. Cannabis itself is not allowed for medical purposes, but a 2015 law allows limited use of non-psychoactive Cannabidiol. An effort was made to place two initiatives on the 2022 ballot, one to legalize medical cannabis, and the other to decriminalize personal use.
Cannabis in South Dakota is legal for medical use as of July 1, 2021, having been legalized by a ballot initiative on November 3, 2020. Prior to then, cannabis was fully illegal, with South Dakota being the only U.S. state which outlawed ingestion of controlled substances. Testing positive for cannabis can be a misdemeanor offense. South Dakota would have become the first state in US history to legalize recreational and medical cannabis simultaneously, but an amendment legalizing recreational marijuana that was approved in the same election was struck down as unconstitutional the following February. The challenge claimed the amendment violated Amendment Z, the "Single-Subject Rule". The decision was appealed to the South Dakota Supreme Court, which upheld the lower court's decision on November 24, 2021.
Cannabis in North Dakota is legal for medical use but illegal for recreational use. Since 2019 however, possession under a 1/2 ounce has been decriminalized in the sense that there is no threat of jail time, though a criminal infraction fine up to $1,000 still applies. The cultivation of hemp is currently legal in North Dakota. In November 2018, the state's voters voted on recreational marijuana legalization, along with Michigan; the measure was rejected 59% to 41%. Two groups attempted to put marijuana legalization measures on the June 2020 Primary and the November 2020 elections, but were prevented from doing so by the COVID-19 pandemic.
Maine Question 1, formally An Act to Legalize Marijuana, is a citizen-initiated referendum question that qualified for the Maine November 8, 2016 statewide ballot. It was qualified for the ballot after a Maine Superior Court judge ordered that petitions rejected by the Maine Secretary of State be reconsidered. The proposal sought to legalize the recreational use of marijuana in Maine for those over the age of 21, and institute a 10 percent tax on its sale. As the Maine Legislature and Governor Paul LePage declined to enact the proposal as written, it appeared on the ballot along with elections for President of the United States, Maine's two U.S. House seats, the Legislature, other statewide ballot questions, and various local elections.
The Adult Use of Marijuana Act (AUMA) was a 2016 voter initiative to legalize cannabis in California. The full name is the Control, Regulate and Tax Adult Use of Marijuana Act. The initiative passed with 57% voter approval and became law on November 9, 2016, leading to recreational cannabis sales in California by January 2018.
Cannabis in Arizona is legal for recreational use. A 2020 initiative to legalize recreational use passed with 60% of the vote. Possession and cultivation of recreational cannabis became legal on November 30, 2020, with the first state-licensed sales occurring on January 22, 2021.
Cannabis in Maryland is legal for medical use and recreational use. Possession of up to 1.5 ounces and cultivation of up to 2 plants is legal for adults 21 years of age and older. In 2013, a state law was enacted to establish a state-regulated medical cannabis program. The program, known as the Natalie M. LaPrade Maryland Medical Cannabis Commission (MMCC) became operational on December 1, 2017.
Cannabis in Florida is illegal for recreational use. Possession of up to 20 grams is a misdemeanor offense, punishable by up to a year in jail, a fine of up to $1000, and the suspension of one's driver's license. Several cities and counties have enacted reforms to apply lesser penalties, however.
Cannabis in Ohio is legal for recreational use. Issue 2, a ballot measure to legalize recreational use, passed by a 57–43 margin on November 7, 2023. Possession and personal cultivation of cannabis became legal on December 7, 2023. The first licensed sales started on August 6, 2024. Prior to legalization, Ohio decriminalized possession of up 100 grams in 1975, with several of the state's major cities later enacting further reforms.
Cannabis in Michigan is legal for recreational use. A 2018 initiative to legalize recreational use passed with 56% of the vote. State-licensed sales of recreational cannabis began in December 2019.
Ashley Brooke Moody is an American attorney and politician serving as the attorney general of Florida since January 2019. Moody previously served as an assistant U.S. attorney and a circuit court judge in Hillsborough County.
Montana I-190, the Montana Marijuana Legalization and Tax Initiative was a cannabis legalization initiative that appeared on the November 3, 2020 Montana general election ballot. Passing with 57% approval, the initiative legalized recreational marijuana in the state effective January 1, 2021. Along with Arizona, New Jersey and South Dakota, Montana was one of four states that legalized cannabis via ballot measures in the November 2020 election.
Arizona Proposition 207 was a voter initiative that appeared on the November 3, 2020, Arizona general election ballot to legalize cannabis for recreational use. Passing with 60% of the vote, the initiative legalized the possession of up to an ounce of cannabis, licensed sales at dispensaries, and personal cultivation of up to six plants. Along with Montana, New Jersey and South Dakota, Arizona is one of four states that legalized recreational marijuana via ballot measures in 2020.
2022 Missouri Constitutional Amendment 3, also known as the Marijuana Legalization Initiative, was a ballot measure to amend the Constitution of Missouri to legalize cannabis at the state level in Missouri. The measure was on the November 7, 2022, general ballot and was approved by voters with a margin of 53–47 percent.
Oklahoma State Question 820 was a voter initiative to legalize adult purchasing, possession and consumption of cannabis in the U.S. state of Oklahoma. It would have placed Oklahoma Medical Marijuana Authority in charge of business regulation. It appeared on the March 7, 2023 in a special election to consider this single State Question. Governor Kevin Stitt, who opposed the measure, set the special election in a successful attempt to limit voter turnout.
Florida Amendment 3, is a proposed constitutional amendment to the Florida Constitution subject to a direct voter referendum on November 5, 2024 that would legalize cannabis for possession, purchase, and recreational use in Florida for adults 21 years or older.
