Latae sententiae (Latin meaning "of a judgment having been brought") and ferendae sententiae (Latin meaning "of a judgment having to be brought") are ways sentences are imposed in the Catholic Church in its canon law. [1]
A latae sententiae penalty is a penalty that is inflicted ipso facto , automatically, by force of the law itself, at the very moment a law is contravened, hence a broadly applied judgment. A ferendae sententiae penalty is a penalty that is inflicted on a guilty party only after a case has been brought and decided by an authority in the Church. [2]
The 1983 Code of Canon Law, which binds Catholics of the Latin Church, inflicts latae sententiae censures for certain forbidden actions. The current canon law that binds members of the Eastern Catholic Churches, the Code of Canons of the Eastern Churches , does not include latae sententiae penalties. [3]
The application of a latae sententiae penalty requires no intervention by a judge. It falls therefore mainly to individual faithful who, if they have committed a crime for which a latae sententiae penalty is envisaged, must conscientiously assess the existence of some mitigating circumstance. [4]
The censures that the 1983 Code of Canon Law envisages are excommunication, interdict, and suspension. Excommunication prohibits participation in certain forms of liturgical worship and church governance. [5] Interdict involves the same liturgical restrictions as excommunication, but does not affect participation in church governance. [6] Suspension, which affects only members of the clergy, prohibits certain acts by a cleric, whether the acts are of a religious character deriving from his ordination ("acts of the power of orders") or are exercises of his power of governance or of rights and functions attached to the office he holds. [7]
Unless the excusing circumstances outlined in canons 1321–1330 [8] exist, the 1983 Code of Canon Law (significantly updated in 2021) [9] imposes latae sententiae excommunication on the following:
Legislation outside of the 1983 Code of Canon Law may also decree latae sententiae excommunication. An example is that governing papal elections, which applies it to persons who violate secrecy, or who interfere with the election by means such as simony or communicating the veto of a civil authority. [19]
The ipso facto excommunication that applied before 1983 to Catholics who became members of Masonic associations was not maintained in the 1983 Code of Canon Law that came into force in that year. However, the Holy See has declared that membership remains forbidden and that "The faithful who enrol in Masonic associations are in a state of grave sin and may not receive Holy Communion". [20]
Instances in which one incurs a latae sententiae interdict include the following:
An example of an interdict that is not latae sententiae but instead ferendae sententiae is that given in canon 1374 of the 1983 Code of Canon Law: "One who joins an association which plots against the Church is to be punished with a just penalty; one who promotes or moderates such an association, however, is to be punished with an interdict." [24]
Automatic suspension applies to clerics (those who have been ordained at least to the diaconate) in the following cases:
Ferendae sententiae suspension (along with other punishments) is to be inflicted on any cleric who openly lives in violation of chastity [32] and on any priest who "in the act, on the occasion, or under the pretext of confession" solicits a penitent to a sexual sin. [33]
If one commits an ecclesiastical offence for which a ferendae sententiae punishment is prescribed, the penalty takes effect only when imposed by the competent ecclesiastical authority. [2] It can also happen that the ecclesiastical authority issues a declaration that a particular individual has in fact incurred a latae sententiae censure. In both these cases the effects are more severe than those of a merely automatic censure. [34]
Those under interdict or excommunication of any kind are forbidden to receive the sacraments, including the Eucharist. [35] If the excommunication has been imposed or declared, others are obliged to prevent the censured person from acting in a ministerial capacity in the liturgy or, if this proves impossible, to suspend the liturgical service; [36] and the censured person is not to be admitted to Holy Communion [37] (see canon 915).
Apart from cases where remission of a censure is reserved to the Holy See, it is for the ordinary responsible for its infliction or, after he has been consulted or in extraordinary circumstances in which such consultation is not possible, the ordinary of the locality where the censured person is present to remit a declared or imposed censure established by law. [38] However, an ordinary can remit a merely automatic censure for his subjects, wherever they are, and for anyone present in his territory or who committed the delict in his territory, and any bishop can remit merely automatic censures for anyone whose sacramental confession he is hearing. [39]
If a penitent finds it burdensome to remain in grave sin for the duration of the time necessary for obtaining remission by the competent authority from an undeclared latae sententiae excommunication or interdict that excludes the penitent from the sacraments, the confessor may immediately remit the censure in the internal sacramental forum, while requiring the penitent to have recourse within one month to the competent authority. [40]
Remission cannot be granted to someone who maintains contumacy, nor can it be denied to someone who withdraws from contumacy. [41]
Crimen sollicitationis is the title of a 1962 document ("instruction") of the Holy Office codifying procedures to be followed in cases of priests or bishops of the Catholic Church accused of having used the sacrament of Penance to make sexual advances to penitents. It repeated, with additions, the contents of an identically named instruction issued in 1922 by the same office.
In Catholic canon law, an interdict is an ecclesiastical censure, or ban that prohibits certain persons or groups from participating in particular rites, or that the rites and services of the church are prohibited in certain territories for a limited or extended time.
Emmanuel Milingo is an excommunicated former Roman Catholic archbishop from Zambia. He was ordained in 1958; in 1969, aged 39, Milingo was consecrated by Pope Paul VI as the bishop of the Archdiocese of Lusaka. In 1983, he stepped down from his position as Archbishop of Lusaka after criticism for exorcism and faith healing practices that were not approved by church authorities. In 2001, when Milingo was 71, he received a marriage blessing from Sun Myung Moon, the leader of the Unification Church, despite the prohibition on marriage for ordained priests. In July 2006, he established Married Priests Now!, an advocacy organization to promote the acceptance of married priests in the Roman Catholic Church.
In the canon law of the Catholic Church, a distinction is made between the internal forum, where an act of governance is made without publicity, and the external forum, where the act is public and verifiable. In canon law, internal forum, the realm of conscience, is contrasted with the external or outward forum; thus, a marriage might be null and void in the internal forum, but binding outwardly, i.e., in the external forum, for want of judicial proof to the contrary.
The Catholic Church first prohibited Catholics from membership in Masonic organizations and other secret societies in 1738. Since then, at least eleven popes have made pronouncements about the incompatibility of Catholic doctrines and Freemasonry.
In the Catholic Church, the Seal of Confession is the absolute duty of priests or anyone who happens to hear a confession not to disclose anything that they learn from penitents during the course of the Sacrament of Penance (confession). Even where the seal of confession does not strictly apply – where there is no specific serious sin confessed for the purpose of receiving absolution – priests have a serious obligation not to cause scandal by the way they speak.
Ecclesia Dei is the document Pope John Paul II issued on 2 July 1988 in reaction to the Ecône consecrations, in which four priests of the Society of Saint Pius X were ordained as bishops despite an express prohibition by the Holy See. The consecrating bishop and the four priests consecrated were excommunicated. John Paul called for unity and established the Pontifical Commission Ecclesia Dei to foster a dialogue with those associated with the consecrations who hoped to maintain both loyalty to the papacy and their attachment to traditional liturgical forms.
Alfonso de Galarreta Genua,, is a Spanish-born Argentine traditionalist Catholic bishop of the Society of Saint Pius X. Bishop de Galarreta has served as the First Assistant of the Society of Saint Pius X, working under the direction of the Superior General Fr. Davide Pagliarani, since 2018. In addition to this, Bishop de Galaretta has been the President of the SSPX—Vatican Commission since 2009, which directs the Society's correspondence with the Holy See.
Validity and liceity are concepts in the Catholic Church. Validity designates an action which produces the effects intended; an action which does not produce the effects intended is considered "invalid". Liceity designates an action which has been performed legitimately; an action which has not been performed legitimately is considered "illicit". Some actions can be illicit, but still be valid.
The Sacrament of Penance is one of the seven sacraments of the Catholic Church, in which the faithful are absolved from sins committed after baptism and reconciled with the Christian community. During reconciliation, mortal sins must be confessed and venial sins may be confessed for devotional reasons. According to the dogma and unchanging practice of the church, only those ordained as priests may grant absolution.
Reserved cases or reserved sins is a term of Catholic doctrine, used for sins whose absolution is not within the power of every confessor, but is reserved to himself by the superior of the confessor, or only specially granted to some other confessor by that superior.
In the Catholic Church, the Precepts of the Church, sometimes called the Commandments of the Church, are certain laws considered binding on the faithful. As usually understood, they are moral and ecclesiastical, broad in character and limited in number. In modern times there are five.
Canon 1397 §2 is a paragraph of the canon 1397 of the 1983 Code of Canon Law of the Catholic Church; the paragraph states: "A person who actually procures an abortion incurs a latae sententiae excommunication".
Canon 915, one of the canons in the 1983 Code of Canon Law of the Latin Church of the Catholic Church, forbids the administration of Holy Communion to those upon whom the penalty of excommunication or interdict has been imposed or declared, or who obstinately persist in manifest grave sin:
Those who have been excommunicated or interdicted after the imposition or declaration of the penalty and others obstinately persevering in manifest grave sin are not to be admitted to holy communion.
The canonical situation of the Society of Saint Pius X (SSPX), a group founded in 1970 by Archbishop Marcel Lefebvre, is unresolved. The Society of Saint Pius X has been the subject of much controversy since 1988, when Bernard Fellay, Bernard Tissier de Mallerais, Richard Williamson and Alfonso de Galarreta were illicitly consecrated as bishops at Ecône, at the International Seminary of Saint Pius X, in violation of canon law. Lefebvre and the four other SSPX bishops individually incurred a disciplinary latae sententiae excommunication for this schismatic act. The excommunications of the four living SSPX bishops were remitted in 2009.
In the canon law of the Catholic Church, excommunication is a form of censure. In the formal sense of the term, excommunication includes being barred not only from the sacraments but also from the fellowship of Christian baptism. The principal and severest censure, excommunication presupposes guilt; and being the most serious penalty that the Catholic Church can inflict, it supposes a grave offense. The excommunicated person is considered by Catholic ecclesiastical authority as an exile from the Church, for a time at least.
A censure, in the canon law of the Catholic Church, is a medicinal and spiritual punishment imposed by the Church on a baptized, delinquent, and contumacious individual. This punishment deprives the person, either wholly or partially, of certain spiritual goods until they resolve their contumacy. These spiritual goods may include access to the sacraments, participation in specific liturgical activities, and involvement in ecclesiastical functions.
Decree on the Attempted Ordination of Some Catholic Women is a canonical decree issued by the Congregation for the Doctrine of the Faith, under Cardinal Joseph Ratzinger, and approved by Pope John Paul II on December 21, 2002. It can be found in Acta Apostolicae Sedis 95 (2003). The decree is in response to Romulo Antonio Braschi ordaining seven Catholic women to the priesthood of his movement, the Catholic Apostolic Charismatic Church of Jesus the King, on June 29, 2002, and is a follow-up to a decree of excommunication of Braschi and the women issued on August 5, 2002.
Pascite gregem Dei is an apostolic constitution issued by Pope Francis on 1 June 2021 which reforms Book VI of the 1983 Code of Canon Law. It took effect on 8 December 2021.
